Source of jurisdiction
Jurisdiction = Board's direction (area / persons / class of income / cases)
An authority can act only on assessees or cases allotted to it. Say who allots and on what basis.
Civil court powers
Discovery + Inspection + Enforcing attendance + Examination on oath + Compelling production of documents + Issuing commissions
These are the matters treated as under the Code of Civil Procedure, 1908, for the purposes of the Act. Learn the list in this order.
Survey vs search
Survey: inspect books, place identification marks, take inventory of cash/stock/valuables, record statements; impound books only with prior approval | Search: enter, seize, require explanation
Survey is milder. There is no seizure of cash, stock or valuables in a survey; only an inventory is taken. Books can be impounded in a survey only with prior approval. Seizure and requiring an explanation belong to a search.
Impounding books in survey
Impound books only with prior approval of the specified senior authority; retain beyond the permitted working days only with further approval
Impounding is a distinct, approval-dependent power. The Act sets the number of working days and the approval ranks. Check them in your latest ICAI material and quote them as given.
Objection to jurisdiction
Objection must be raised within the period given in the Act after receiving the specified notice, or before the assessment is completed, whichever is earlier; otherwise it is barred
The time limit runs from a notice that the assessee has received. An assessee who raises the objection late, for example after the assessment is complete, cannot succeed on it. Check the exact notice and period in your ICAI material.
Answer structure
Provision → Facts → Conclusion
Write the rule, apply it to the case in one or two lines, then state the result.
Trigger rule
Breach of conditions of recognition or approval → authority may withdraw
Name the specific breach from the facts. Do not say the status is lost for any default.
Procedure rule
Withdrawal order = notice + opportunity of being heard + reasoned written order
Quote this in every procedural question. Lack of a hearing is the usual ground to challenge an order.
Effect on employees' provident fund
Unrecognised fund: employer's contribution + interest on it = salary; interest on employee's contribution = other sources
The employee's own contributions are not taxed again as income. Where a deduction was claimed earlier on them, check the specific rule in your study material.
Effect on trusts and institutions
Status withdrawn → exemption and approval-linked benefits lost from the effective date
Study the extra tax on accumulated assets for trusts in the registration and violation topics. Do not quote a section number you cannot confirm.
Net premium income
Net premium income = Premium received and receivable − Reinsurance premium paid or payable
Work class by class. Use the net figure, not the gross premium, as the base for the cap.
Cap for marine business (cargo)
Limit = 100% × Net premium income of the tax year
Applies to marine insurance business (cargo). Source: the special provision for general insurance business under the Income-tax Act, 2025, corresponding to Rule 6 of the First Schedule to the earlier 1961 Act.
Cap for other general insurance
Limit = 50% × Net premium income of the tax year
Applies to fire and miscellaneous insurance business. Same source as the marine cap.
Allowable reserve
Allowed closing reserve = Actual closing reserve created in accounts, limited to the Limit
The reserve must actually be created in the accounts. A limit alone gives no deduction. If the actual reserve is below the limit, only the actual reserve is allowed.
Adjustment to book profit
Adjustment = (Closing reserve in books − Opening reserve in books) − (Allowed closing reserve − Opening reserve allowed earlier)
The charge in the books is replaced by the allowed amount. A positive result is added to book profit. A negative result is deducted. Simplified case: if there is no opening reserve and the books charged the full closing reserve, the adjustment is the closing reserve minus the allowed reserve, that is, the excess only. Use this only where those two conditions hold.

Quick revision

  • Use Income-tax Act, 2025 terms: tax year, not assessment year.
  • For each tax authority power, remember who exercises it and the condition for exercise.
  • Procedure matters: check whether the authority recorded reasons or followed the required steps before acting.
  • Accumulated balance treatment depends on the fund's recognition and the conditions met at the time of payment.
  • Always test whether the fund is recognised before applying the accumulated balance rule.
  • Check service and other conditions in the facts before concluding that a payment is exempt.
  • Withdrawal of recognition has a trigger and a date from which its effect starts.
  • Identify what becomes taxable on withdrawal, and in whose hands.
  • Insurer reserve for unexpired risks is a rule specific to insurers and sits within their business profits computation.
  • Write answers as provision, facts, conclusion.
  • Confirm section numbers in the ICAI tax year 2026-27 material before the exam.

Common mistakes

  • Treating survey and search as the same thing. Fix: Remember that survey verifies, marks books, takes inventory and records statements, and books can be impounded only with approval. Search is the stronger action that allows seizure. Cash, stock and valuables found in a survey are inventoried, not seized.
  • Saying books can be impounded in a survey by any officer at any time. Fix: Always add that impounding is a distinct power that needs prior approval of the specified senior authority, and that retention is time-bound.
  • Treating withdrawal as automatic on any default. Fix: Always write that the authority must give notice and a hearing and pass a reasoned order.
  • Taxing the whole fund balance as salary after withdrawal. Fix: Split the balance into four parts. Tax the employer's contribution and its interest as salary, the interest on the employee's contribution as other sources, and leave the employee's own contribution out.
  • Applying the percentage to gross premium instead of net premium income. Fix: Deduct reinsurance premium first. Write the net figure before applying 100% or 50%.
  • Allowing the full limit even when the actual reserve created is lower. Fix: The limit is a ceiling. The deduction is the actual reserve created, restricted to the limit.

Exam tips

  • Case-scenario MCQs often hide the wrong word, such as 'without approval' in impounding or 'seized' where the facts describe only a survey. Read the verbs carefully and test each against the Act's conditions.
  • In written answers, use the provision, facts, conclusion format and keep each part short.
  • Compare survey, search and enquiry in a small list. Examiners like clear differences, but do not draw tables unless asked.
  • Always check the rank of the authority against the power used. A lower-rank officer acting alone is a common trap.
  • Quote section numbers only from the Income-tax Act, 2025 as given in your study material. Otherwise explain the rule in words.
  • Begin every answer by naming the entity and its status. Examiners mark the correct classification first.
  • In case-scenario MCQs, check whether a hearing was given and what the effective date is. These two facts usually decide the option.
  • In the computation, show the four-way split of contributions and interest. Marks go to each correctly classified component.
