Key formulas

Import
Import = bringing into India from a place outside India
Direction matters. Coastal movement between two Indian ports is not import.
Export
Export = taking out of India to a place outside India
India includes the territorial waters of India.
Goods (section 2(22))
Goods includes vessels, aircraft, vehicles; stores; baggage; currency and negotiable instruments; any other movable property
Immovable property is outside the definition.
Customs station (section 2(13))
Customs station = customs port, customs airport, international courier terminal, foreign post office or land customs station
Learn all five parts of the list.
Customs area (section 2(11))
Customs area = area of a customs station or a warehouse, plus any area where imported or export goods are ordinarily kept before clearance
Includes warehouse area.
Imported goods (section 2(25))
Imported goods = goods brought into India from outside, excluding goods cleared for home consumption
Status ends on clearance for home consumption.
Dutiable goods (section 2(14))
Dutiable goods = chargeable to duty and duty not yet paid
Once duty is paid, the goods are no longer dutiable goods.
Prohibited goods (section 2(33))
Prohibited goods = import or export subject to prohibition, excluding goods where permission conditions are complied with
Restricted goods that meet conditions are not prohibited.
Baggage (section 2(3))
Baggage includes unaccompanied baggage but does not include motor vehicles
A car is not baggage.
Market price (section 2(30))
Market price = wholesale price of the goods in the ordinary course of trade in India
Wholesale, not retail.
Classes of officers (Section 3)
Principal Chief Commissioner → Chief Commissioner → Principal Commissioner → Commissioner → Principal Commissioner (Appeals) → Commissioner (Appeals) → Additional → Joint → Deputy → Assistant Commissioner → other classes
Follow the order in clauses (a) to (k). Clause (k) covers other classes appointed for the purposes of the Act.
Appointment by the Board (Section 4(1))
Board may appoint such persons as it thinks fit to be officers of customs
This is the general power and the starting point.
Delegated appointment (Section 4(2))
Board authorises senior officers → they appoint officers below the rank of Assistant or Deputy Commissioner
The authorised officers are Principal Chief Commissioner or Chief Commissioner, Principal Commissioner or Commissioner, and Joint, Assistant or Deputy Commissioner. The authorisation comes from the Board.
Proper officer (Section 5(1A) and (1B))
Board by notification, or Principal Commissioner or Commissioner by order within assigned jurisdiction, assigns functions → that officer is the proper officer
The 1B assignment is by order, only within the jurisdiction assigned by the Board.
Subordinate powers (Section 5(2))
An officer may exercise the powers of any officer subordinate to him
It works downwards only.
Commissioner (Appeals) limit (Section 5(3))
Commissioner (Appeals) exercises only powers specified in Chapter XV, section 108 and sub-section (1D) of section 110
Other officer powers are not available to him.
Section 7: appointment of places
Board, by notification in the Official Gazette, appoints customs ports, customs airports, inland container depots / air freight stations, land customs stations, routes, coastal ports, foreign post offices, international courier terminals
The Board appoints. The places named are the only ones for the stated purpose.
Section 8(a): landing places
Principal Commissioner of Customs or Commissioner of Customs may approve proper places in a customs port, customs airport or coastal port for unloading and loading of goods or any class of goods
The power is to approve places inside a port or airport already appointed. It is not a power to appoint the port.
Section 8(b): customs area
Principal Commissioner of Customs or Commissioner of Customs may specify the limits of any customs area
This fixes the boundary of the area.
Section 10: boarding station
Principal Commissioner of Customs or Commissioner of Customs may, by notification in the Official Gazette, appoint a boarding station in or near any customs port
Purpose: boarding of, or disembarkation from, vessels by officers of customs.
Section 109: goods imported by land
Authorised customs officer in an area adjoining the land frontier may require a person in possession of goods believed imported by land to produce the Section 47 order permitting clearance
Proviso: it does not apply to goods passing from a land frontier to a land customs station by a route appointed under Section 7(c).

Quick revision

  • Customs Act, 1962 governs import into and export out of India.

  • Section 141: conveyances and goods in a customs area are subject to the control of officers of customs.
  • Section 45: imported goods in a customs area stay in approved custody until cleared, warehoused or transhipped.
  • Section 151 requires listed officers, such as police and Navy, to assist customs officers.
  • Section 151A: Board instructions cannot direct an officer to make a particular assessment or decide a case in a particular way.

Common mistakes

  • Treating motor vehicles as baggage Fix: Remember section 2(3): baggage includes unaccompanied baggage but does not include motor vehicles.
  • Thinking goods means only physical items for sale Fix: Goods includes vessels, aircraft, vehicles, stores, baggage, currency, negotiable instruments and any other movable property.
  • Saying a Commissioner can appoint any customs officer. Fix: Write that appointment by these officers is only of officers below Assistant or Deputy Commissioner rank, and only when the Board authorises.
  • Listing classes out of order or leaving out the Commissioner (Appeals) classes. Fix: Remember the clause order (a) to (k). Include Principal Commissioner (Appeals) and Commissioner (Appeals) and the other class under clause (k).
  • Saying the Commissioner appoints customs ports under Section 8. Fix: Remember that the Board appoints ports and airports under Section 7. The Commissioner only approves places and sets limits inside them under Section 8.
  • Saying the Board specifies the limits of the customs area. Fix: Section 8(b) gives this power to the Principal Commissioner of Customs or Commissioner of Customs.

Exam tips

  • Learn section 2 definitions word for word. MCQs often change one phrase, such as wholesale price or motor vehicles.
  • In written answers, quote the section number with each definition and then apply it to the facts.
  • Use a short list format for goods, customs station and customs area, so each element earns a mark.
  • In case-style questions, state the direction of movement first. It decides import or export in one line.
  • Revise this topic with customs ports, airports and customs area, since the same terms appear there.
  • Learn the Section 3 list in order and write it as a numbered list in the answer.
  • In short answers, always pair a rule with its section number: Section 4(1) for the Board, Section 4(2) for delegation.
