Speculation Business Losses: Set Off and Carry Forward
Updated 5 October 2026 · Fact-checked
A speculative transaction is a contract for buying or selling a commodity, including shares, that is settled without actual delivery. Under the Income-tax Act, 2025, speculation business loss can be set off only against speculation business profit. Unabsorbed loss is carried forward for up to four immediately following tax years, and set off only against speculation profit.
Understand Speculation Business Losses
This page follows the Income-tax Act, 2025 and its "tax year" wording. A speculative transaction is a contract to buy or sell a commodity, including stocks and shares, which is settled otherwise than by actual delivery or transfer of the commodity. The classic case is intraday share trading: you buy and sell the same shares on the same day and only the difference is settled. No shares are delivered, so the transaction is speculative.
The Act treats the profit or loss from such transactions as a separate business, called speculation business. It is kept apart from your normal business even if you run both. You compute the result of all speculative transactions together. A net profit is taxed as business income. A net loss is a speculation loss.
The key idea is a one-way wall. Speculation loss can be set off only against profit from speculation business. It cannot be set off against normal business profit, capital gains, salary, house property or other sources. In the other direction, a loss from normal business can be set off against speculation profit. So the wall blocks the loss from going out, but not other losses from coming in.
If the loss is not fully absorbed in the year, you carry it forward. Under the Income-tax Act, 2025, it is set off in later tax years only against speculation business profit, and for a limited period of four tax years immediately following the tax year in which the loss was first computed. The speculation business need not continue; the loss can be set off against profit of any speculation business in those years.
There is a procedural condition. The right to carry forward the speculation loss depends on the return of loss being furnished within the due date. This condition governs carry forward only. Set off of the loss against speculation profit of the same tax year remains available even if the return is late.
Some transactions look speculative but are excluded by the Act. These include genuine hedging contracts, and eligible derivative transactions on a recognised stock exchange. These are treated as non-speculative, so their loss follows the normal business loss rules. Always classify the transaction first. Everything else in the problem depends on it.
Key rules to remember
- Speculative transaction
- Contract for purchase or sale of a commodity (including stocks and shares) settled otherwise than by actual delivery or transfer
- Delivery-based share trading is not speculative. Squaring off without delivery is.
- Excluded (non-speculative) transactions
- Hedging contracts + eligible derivative transactions on recognised exchanges + other contracts the Act specifically excludes
- Hedging means a contract by a manufacturer or merchant to guard against price loss on raw materials or merchandise, or by a dealer or investor against loss on shares held. Check the exact conditions in the Act.
- Current-year set off
- Speculation loss ≤ set off only against speculation profit of the same tax year
- No set off against normal business, capital gains, or any other head. This remains available even if the return is filed late.
- Carry forward (Income-tax Act, 2025)
- Unabsorbed speculation loss → carried forward up to 4 tax years immediately following the year of loss
- Set off only against speculation business profit. The business need not continue. Carry forward needs the return of loss to be filed by the due date.
- Reverse set off
- Normal business loss (current or brought forward) can be set off against speculation profit
- This is the main difference from speculation loss.
- Order of set off in a later year
- Earliest unabsorbed speculation loss is set off first against speculation profit
- Keep each year's loss separate so you can track the four-year limit.
How to solve Speculation Business Losses questions
Use this sequence for any question on speculation loss, whether it asks for set off, carry forward or total income.
- 1Classify each transaction. Ask: is it settled without delivery? If yes, is it a hedge or an eligible derivative transaction excluded by the Act? Only the remaining ones are speculative.
- 2Compute speculation business result separately from normal business result. Net all speculative transactions together, after the related expenses.
- 3If speculation shows a profit, add it to business income. You may set off current-year normal business loss and brought-forward normal business loss against it, as per the order of set off.
- 4If speculation shows a loss, do not set it off against any other income of the year. Only other speculation profit of the same year can absorb it.
- 5Carry forward the unabsorbed loss if the return of loss was filed by the due date. Mark the tax year in which it arose.
- 6In later years, set off brought-forward speculation loss only against speculation profit, earliest loss first. Drop any loss that is more than four tax years old.
- 7Compute gross total income from the remaining heads, with no deduction for the speculation loss, and state the loss carried forward.
Quickest way: Wall-and-clock check
When to use it: Use when the question gives several incomes and losses and you have only a few minutes.
- Draw two boxes: Speculation and Everything else.
- Put each item in a box after checking for delivery and the hedge or derivative exclusions.
- If the Speculation box is negative, leave it out of total income and write it as carried forward.
- If the Everything else box has a business loss, you may use it against speculation profit.
- For brought-forward loss, count four tax years from the year of loss. If it is beyond that, it lapses.
- Write the carry forward figure and the last tax year in which it can be used.
Common mistakes in Speculation Business Losses
Setting off speculation loss against normal business profit or capital gains.
Students treat all business losses alike or assume all losses can be set off within the same head.
Fix: Remember that speculation business is a separate business. Its loss can be set off only against speculation profit.
Treating all share trading as speculative.
Students see 'shares' and 'trading' and stop there.
Fix: Check for delivery. Delivery-based trading is not speculative. Also check for hedging and eligible derivative exclusions.
Refusing to set off normal business loss against speculation profit.
Students over-apply the one-way restriction in both directions.
Fix: Normal business loss can be set off against speculation profit. Only the reverse is barred.
Carrying speculation loss forward for eight years.
Eight years is the carry forward period for normal business loss, so the two get mixed up.
Fix: Speculation loss is carried forward for four tax years immediately following the year of loss. Normal business loss gets eight. Write the limit in your answer.
Ignoring the due date for filing the return of loss, or applying it to the wrong thing.
Students focus on computation and forget the procedural condition, or they think a late return also blocks same-year set off.
Fix: State that carry forward is allowed only if the return of loss is furnished within the due date. The condition affects carry forward only. Same-year set off against speculation profit is still allowed.
Thinking the loss can be used only if the same speculation business continues.
Students confuse it with rules for other business losses.
Fix: Speculation loss can be set off against profit of any speculation business in the allowed years. The business need not be the same or continue.
Worked examples
Example 1
Ravi has business income of ₹6,00,000 from trading in cloth, short-term capital gain of ₹1,00,000 and a loss of ₹2,00,000 from intraday equity share trading (squared off without delivery) in the tax year. Compute his gross total income and the loss to be carried forward. Assume his return is filed on time.
Show the solution
- Classify: intraday trading is settled without delivery and is not a hedge or excluded derivative. It is a speculative transaction.
- Speculation result is a loss of ₹2,00,000. There is no other speculation profit in the year.
- The loss cannot be set off against cloth business profit or capital gains.
- Business income remains ₹6,00,000 and capital gains ₹1,00,000.
- Gross total income = ₹6,00,000 + ₹1,00,000 = ₹7,00,000.
- The full speculation loss of ₹2,00,000 is carried forward, as the return is filed on time.
Answer: Gross total income is ₹7,00,000. Speculation loss of ₹2,00,000 is carried forward, to be set off only against speculation profit in the next four tax years.
Example 2
Meera incurred a speculation loss of ₹3,00,000 in Tax Year 1. Her speculation profits were ₹50,000 in Year 2, nil in Year 3, ₹1,00,000 in Year 4, ₹40,000 in Year 5 and ₹70,000 in Year 6. Returns were filed on time. Show the set off, the taxable speculation income each year and the loss that lapses.
Show the solution
- Loss arose in Year 1, so it can be carried forward to Years 2 to 5 only (four immediately following tax years).
- Year 2: set off ₹50,000. Taxable speculation income nil. Balance loss ₹2,50,000.
- Year 3: no speculation profit, so no set off. Balance stays ₹2,50,000.
- Year 4: set off ₹1,00,000. Taxable nil. Balance ₹1,50,000.
- Year 5: set off ₹40,000. Taxable nil. Balance ₹1,10,000. This is the last year in which the loss can be used.
- Year 6 is outside the four-year window, so no set off is allowed. The profit of ₹70,000 is taxable in full.
- The unabsorbed balance of ₹1,10,000 lapses.
Answer: Taxable speculation income is nil in Years 2, 3, 4 and 5, and ₹70,000 in Year 6. Loss of ₹1,10,000 remains unabsorbed after Year 5 and lapses.
Exam tips
- Start every answer with the classification of the transaction. Examiners often hide a hedge or a delivery-based trade in the facts.
- State the rule in provision-facts-conclusion form: speculation loss is set off only against speculation profit, apply to the figures, then conclude with the carry forward.
- Use a small list of years in carry forward questions. Mark the last year of use clearly.
- In MCQs, check whether the question asks about set off in the same year or carry forward, and whether normal business loss is being set off against speculation profit.
- Mention the return-of-loss due date condition in written answers, and say it governs carry forward only; it earns a mark easily.

Speculation Business Losses: frequently asked questions
What is a speculative transaction for income tax?
It is a contract for the purchase or sale of a commodity, including stocks and shares, which is settled without actual delivery or transfer. Intraday share trading is the common example. Hedging contracts and eligible derivative transactions on recognised exchanges are excluded by the Act.
For how many years can speculation loss be carried forward?
Under the Income-tax Act, 2025, it can be carried forward for up to four tax years immediately following the tax year in which it was first computed. In those years it can be set off only against speculation business profit. It lapses if still unabsorbed after that.
What is the difference between speculation loss and normal business loss?
Speculation loss can be set off only against speculation profit, and is carried forward for four tax years. Normal business loss can be set off in the same year against income under other heads, except salary. Its unabsorbed balance is carried forward for eight years and set off only against business income, which includes speculation profit.
Can speculation loss be carried forward if the return is filed late?
No. Carry forward is allowed only if the return of loss is furnished within the due date. If you miss it, you cannot carry the loss forward. The condition affects carry forward only, so the loss can still be set off against speculation profit of the same tax year.
Is future and options trading speculative?
Eligible derivative transactions on a recognised stock exchange are excluded from speculative transactions by the Act. Their loss is therefore treated as normal business loss, not speculation loss. Read the exact exclusion in the question before you decide.
