What this chapter covers
This chapter is the procedural spine of Paper 4. It follows one return through its life: you file it, the department processes it, it may be selected for scrutiny, it may be reopened if income escaped, and either side can correct or challenge the outcome. Each stage has its own authority, notice, time limit and remedy.
The chapter is mostly about who can do what, by when, and on what condition. Computation chapters tell you the tax. This chapter tells you whether the tax demand is valid, whether a notice was issued in time, and what you advise the client to do next.
It connects to almost everything else in the paper. Return filing links to the tax year, due dates, late fee and interest. Assessment links to income computation, losses and carry forward. Reassessment links to the concept of income escaping assessment. Appeals link to penalties, TDS and international taxation matters. Mixing up processing of a return with scrutiny assessment
Fix: Note that processing is a basic check of the return, while scrutiny is a detailed examination after notice. Write the difference in one line.
Counting time limits from the wrong date
Fix: Next to every limit in your notes, write the starting event. Recheck it in each case before computing.
Using the old Act's terms such as assessment year or old section numbers
Fix: Use only the tax year and section numbers from the 2025 Act as given in the current ICAI material.
Stating the rule but not applying it to the facts
Fix: After every rule, add the facts and a clear conclusion. Marks are given for the application.
Treating reassessment as allowed whenever the officer doubts the income
Fix: Check that the conditions, approval and notice requirements are met before saying reassessment is valid.
Confusing rectification, revision and appeal as the same remedy
Fix: Remember: rectification fixes an apparent mistake, revision is an authority reviewing an order, appeal challenges it before a higher forum.
Last-day revision: Assessment Procedure
- Know the sequence: return, processing, scrutiny, order, reopening, correction, appeal.
- Self-assessment tax is the tax left after adjusting TDS, TCS, advance tax and reliefs. It must be paid, with interest, before the return is filed.
- Processing of a return is not the same as scrutiny assessment.
- Scrutiny requires a notice to the taxpayer within the prescribed time.
- Faceless assessment works through electronic communication and team-based allocation.
- Reassessment needs income that has escaped assessment and the prescribed approval and notice.
- Reopening is subject to time limits that depend on the amount of escaped income. Take the exact periods, thresholds and approval requirements from the ICAI material for the Income-tax Act, 2025, and note the starting point of each limit.
- Rectification corrects mistakes apparent from the record.
- Revision orders depend on error and prejudice to revenue or on taxpayer application.
- Appeal route: the first appeal generally lies to the Commissioner (Appeals), conducted through the faceless appeal scheme for most cases, with some exceptions. Then the ITAT, then the High Court on a substantial question of law, then the Supreme Court.
