Instalment Facility under GST: Exclusions and Practical Application
Updated 5 October 2026 · Fact-checked
Section 80 of the CGST Act lets the Commissioner extend time or allow up to 24 monthly instalments if you show you are unable to pay. Interest under section 50 applies to the tax for that period. It excludes the amount due as per the liability declared in your return. Apply in FORM GST DRC-20; default makes the balance recoverable.
Understand Instalment Facility: Exclusions and Practical Application
Sometimes a taxpayer owes GST but cannot pay it at once. The law gives a relief valve: section 80 of the CGST Act, worked out through Rule 158 of the CGST Rules. You apply to the Commissioner in FORM GST DRC-20, state your reasons, and ask for more time or for monthly instalments.
The facility is a favour, not a right. It is available only where you are unable to pay the amount due, and your application must give the reasons for that inability. The Commissioner decides, records reasons in writing, and may allow up to 24 monthly instalments. Section 80 itself provides for interest under section 50 on the tax amount for the period of the extension or the instalments. Rule 158 prescribes the procedure: the application in FORM GST DRC-20 and the order in FORM GST DRC-21. The relief is on timing only, not on the amount of tax.
The most tested exclusion is this: the facility does not cover the amount due as per the liability declared in the return. If you have already self-assessed the tax in your return (for example GSTR-3B) and not paid it, you cannot ask for instalments on that amount. The facility is meant for other dues, such as amounts demanded by an order after a notice.
The link to recovery is the second half of the story. While an extension or instalment arrangement is running, no recovery proceedings can be started for that amount. But under the proviso to section 80, if you default on any one instalment on its due date, the whole outstanding balance becomes payable forthwith. It is recoverable without any further notice. Recovery then follows under section 79, the general recovery provision for arrears.
So think of it as a four-part test in every question: Is the amount eligible? Is the taxpayer unable to pay, and has he applied with reasons? Has the Commissioner allowed it, within 24 months and with interest? Has the taxpayer paid every instalment on time? A failure at any stage points you to recovery.
Key rules to remember
- Maximum period
- Instalments ≤ 24 monthly instalments
- Section 80 allows an extension of time or monthly instalments, not exceeding twenty-four. The Commissioner may grant fewer.
- Excluded amount
- Amount due as per liability declared in return → no instalment facility
- Self-assessed tax shown in the return must be paid on time. Instalments are for other dues, such as demands by order.
- Interest condition
- Instalment facility = relief on timing + interest under section 50 on the tax amount for the extension or instalment period
- Section 80 itself provides for interest under section 50 on the tax amount for the period of extension or instalments. Rule 158 prescribes the procedure. The facility does not waive this interest.
- Condition for the facility
- Taxpayer unable to pay the amount due + application with reasons → Commissioner may allow
- The application states the reasons for inability to pay. Without that, the Commissioner has no basis to grant the facility.
- Protection during the facility
- Extension or instalment period → no recovery proceedings for that amount
- The protection lasts only while you comply with the terms.
- Default rule
- Default in any one instalment → entire outstanding balance payable forthwith and recoverable without further notice (proviso to section 80)
- This is the proviso to section 80. Recovery then follows under section 79, the general recovery provision for arrears.
- Procedure
- Application in FORM GST DRC-20 → Commissioner's order in FORM GST DRC-21
- Under Rule 158(2), the Commissioner may call for a report from the jurisdictional officer before deciding. Reasons for the decision are recorded in writing.
How to solve Instalment Facility: Exclusions and Practical Application questions
Use this sequence for any question on instalments, whatever the facts. It makes you cover provision, facts and conclusion in order.
- 1Identify the amount the taxpayer wants to pay in instalments. Ask whether it is a liability declared in a return or a different due, such as a demand by an order.
- 2Apply the exclusion: if it is the amount declared in the return, say the facility under section 80 is not available for it.
- 3If the amount is eligible, check that the taxpayer is unable to pay it and has applied, normally in FORM GST DRC-20, giving reasons. The Commissioner decides, records reasons, and may call for a report from the jurisdictional officer.
- 4Check the period asked for. The maximum is 24 monthly instalments. If the taxpayer asks for more, the Commissioner can allow at most 24.
- 5State the interest consequence: section 80 provides that interest under section 50 is payable on the tax amount for the period of the extension or instalments.
- 6State the protection: no recovery proceedings during the extension or instalment period for that amount.
- 7Test for default. If any one instalment is missed on its due date, the whole outstanding balance becomes payable immediately and can be recovered without further notice.
- 8Write the conclusion in one line, with a number if the question gives figures: what is allowed, what is payable, what is recoverable.
Quickest way: Three-gate check
When to use it: Use this when time is short, especially for MCQs and for the 30% case-scenario questions.
- Gate 1 – Eligibility: Is the amount already declared in the return? If yes, stop: no instalments.
- Gate 2 – Limits: Is the taxpayer unable to pay, and is the request for 24 monthly instalments or fewer, with interest under section 50? If yes, the Commissioner may allow it. Remember that it is on application with reasons and at his discretion.
- Gate 3 – Compliance: Has any instalment been missed? If yes, the full balance is due at once and recoverable without further notice.
- Divide the amount by the number of instalments only if the question says equal instalments. Add interest separately.
Common mistakes in Instalment Facility: Exclusions and Practical Application
Allowing instalments on tax shown in GSTR-3B but not paid.
Students think any unpaid tax qualifies for relief.
Fix: Remember the exclusion: the amount due as per the liability declared in the return is outside section 80. It must be paid on the due date, with interest if late.
Writing that the facility waives or reduces interest.
Students assume that instalments work like a relief or waiver.
Fix: Write that section 80 provides for interest under section 50 on the tax amount for the extension or instalment period. Rule 158 only prescribes the procedure. Instalments only change the timing of payment.
Saying 'more than 24 instalments may be allowed' or '36 instalments'.
Mixing GST with other laws or with state schemes.
Fix: The cap is 24 monthly instalments. The Commissioner may allow fewer.
Treating the facility as a right that starts when the taxpayer applies.
Students overlook that the taxpayer must show inability to pay and the Commissioner must allow it with reasons recorded.
Fix: Say that relief arises only when the Commissioner grants it on an application stating reasons. Protection from recovery applies for the allowed period.
Recovering only the missed instalment after a default.
Students apply a general contract-style view of instalments.
Fix: Under section 80, default in any one instalment makes the whole outstanding balance due at once, and it is recoverable without further notice.
Forgetting which authority decides.
Confusion between the proper officer in demand proceedings and the Commissioner.
Fix: Write that the application is decided by the Commissioner, who may seek a report from the jurisdictional officer.
Worked examples
Example 1
Case: Vikas Traders filed its GSTR-3B for a month showing output tax of ₹8,00,000 but could pay only ₹3,00,000 in cash. It applies to the Commissioner to pay the balance of ₹5,00,000 in 12 monthly instalments. Can the Commissioner allow this?
Show the solution
- Identify the dues: ₹5,00,000 is the unpaid part of the tax that Vikas Traders itself declared in its return.
- Apply the rule: section 80 does not extend to the amount due as per the liability declared in the return.
- Check the request: 12 instalments are within the 24-month cap, but the cap does not matter because the amount is excluded.
- Consequence: the ₹5,00,000 must be paid with interest under section 50 for the period of delay. Recovery proceedings can follow if it is not paid.
Answer: The instalment facility is not available for the ₹5,00,000. It is tax declared in the return. Vikas Traders must pay it with interest under section 50; the application cannot succeed.
Example 2
Case: An order raises a tax demand of ₹6,00,000 on Meera Enterprises. Meera applies in FORM GST DRC-20, stating that it is unable to pay the amount at once. The Commissioner allows payment in 24 equal monthly instalments of ₹25,000 each, with interest. Meera pays the first 5 instalments on time but misses the 6th. What is the position regarding the tax amount?
Show the solution
- Check eligibility: the amount comes from a demand order and is not a liability declared in a return, and Meera has shown inability to pay, so section 80 applied. Before deciding, the Commissioner may call for a report from the jurisdictional officer under Rule 158(2). He allowed it by an order in FORM GST DRC-21.
- Confirm the instalments: ₹6,00,000 ÷ 24 = ₹25,000 per month.
- Find what has been paid: 5 × ₹25,000 = ₹1,25,000.
- Find the outstanding balance: ₹6,00,000 − ₹1,25,000 = ₹4,75,000. This equals 19 instalments × ₹25,000, including the missed 6th.
- Apply the default rule: under the proviso to section 80, default in any one instalment makes the whole outstanding balance payable forthwith.
- Add the consequence: the ₹4,75,000 is recoverable without further notice, and recovery then follows under section 79. Section 80 provides that interest under section 50 is payable on the tax amount for the period of the extension or instalments.
Answer: The entire outstanding tax of ₹4,75,000 becomes payable forthwith under the proviso to section 80 and is recoverable without any further notice. Recovery follows under section 79, and interest under section 50 is payable on the tax amount for the instalment period, as section 80 provides. The protection from recovery proceedings ends with the default.
Exam tips
- In a case scenario, the first thing to check is the source of the dues. Return-declared tax is the usual trap for the exclusion.
- Keep your answer in provision-facts-conclusion form: section 80 rule, apply to the facts, then a clear yes or no.
- Mention that section 80 provides for interest under section 50, payable on the tax amount for the extension or instalment period, in every answer on this topic. Examiners expect it.
- Mention that the taxpayer must show inability to pay and apply in FORM GST DRC-20 with reasons.
- For numerical questions, show the outstanding balance as total less instalments paid, then say it is due at once on default.
- Write the cap as 'not exceeding 24 monthly instalments', not as a fixed number of instalments.

Instalment Facility: Exclusions and Practical Application: frequently asked questions
Can I pay GST declared in GSTR-3B in instalments?
No. Section 80 excludes the amount due as per the liability declared in the return. You must pay it by the due date, and interest applies if it is late.
What is the maximum number of instalments under Rule 158?
The CGST Act allows monthly instalments not exceeding twenty-four. The Commissioner decides the actual number after considering your application, in which you must show you are unable to pay and give your reasons.
What happens if I miss one instalment?
The whole outstanding balance becomes due at once. It can be recovered without any further notice, using the recovery provisions for arrears.
Is interest payable when instalments are allowed?
Yes. Section 80 itself provides for interest under section 50 on the tax amount for the period of the extension or instalments. Rule 158 only prescribes the procedure. The facility changes only the timing of payment and does not remove the interest cost.
Who decides on the instalment application?
The Commissioner decides, after recording reasons in writing. The application is made in FORM GST DRC-20 with reasons for inability to pay, and he may call for a report from the jurisdictional officer.
