Revocation of Cancellation of Registration (Section 30 CGST Act)
Updated 5 October 2026 · Fact-checked
Revocation of cancellation lets a person whose GST registration was cancelled by the proper officer on his own motion apply to get it restored. You apply in Form GST REG-21 within 30 days of service of the cancellation order. The officer then revokes or rejects it by a speaking order, after a hearing in case of rejection.
Understand Revocation of Cancellation of Registration
Under section 29, a registration can be cancelled in two ways. The registered person can apply for it, or the proper officer can cancel it on his own motion, for example for non-filing of returns or for not commencing business. Section 30 gives a remedy only for the second case.
Think of it as a short window to undo the officer's action. If you were cancelled by the officer and you want to continue in business, you apply to the same officer for revocation. You do not need to take a fresh registration.
The time limit is the core of the topic. You must apply within 30 days from the date of service of the cancellation order. For sufficient cause, the time can be extended. As amended, the Additional or Joint Commissioner can extend it by up to 30 more days. The Commissioner can then extend it by a further period of up to 30 days, for reasons recorded in writing. So the outer limit is about 90 days from service.
The proper officer must decide within 30 days from receipt of the application. He either revokes the cancellation by an order (Form GST REG-22) or rejects the application. Rejection needs written reasons and an opportunity of being heard. If rejected, your remedy is an appeal under the appeal provisions of the Act.
There is a further requirement for one common case. If registration was cancelled for non-filing of returns, the proviso to section 30(1), as amended by the Finance Act 2023, and the related rule provisions require the pending returns up to the date of cancellation to be furnished, with the tax, interest, penalty and late fee due, before revocation is allowed.
Key rules to remember
- Who can apply
- Registered person whose registration was cancelled by the proper officer on his own motion
- Cancellation on the person's own application under section 29 is not covered by section 30. A fresh registration is the route there.
- Basic time limit
- Apply within 30 days from the date of service of the cancellation order
- Count from service of the order, not from the effective date of cancellation.
- Extension of time
- Additional/Joint Commissioner: up to 30 days. Commissioner: a further period up to 30 days (reasons in writing)
- As amended. The extension needs sufficient cause. Total outer limit is about 90 days from service.
- Form and manner
- Application in Form GST REG-21 on the common portal; order of revocation in Form GST REG-22
- Rule 23 of the CGST Rules deals with the procedure.
- Officer's decision time
- Order within 30 days from receipt of the application: revoke or reject
- Rejection needs reasons in writing and an opportunity of being heard.
- Cancellation for non-filing of returns
- Pending returns up to the date of cancellation must be furnished, with tax, interest, penalty and late fee, before revocation is allowed
- This comes from the proviso to section 30(1) as amended by the Finance Act 2023 and the related rule provisions, not from a separate condition in Rule 23.
- Remedy if rejected
- Appeal against the rejection order under the appeal provisions of the Act
- Do not file a second REG-21. The remedy against rejection is appeal.
How to solve Revocation of Cancellation of Registration questions
Use this order for any question on revocation. It keeps your answer in provision, facts and conclusion form.
- 1Find out how the registration was cancelled. If it was on the person's own application, state that section 30 does not apply and a fresh registration is needed.
- 2If the proper officer cancelled it, state that the person may apply for revocation under section 30 in Form GST REG-21.
- 3Note the date the cancellation order was served. Count 30 days from that date.
- 4Compare the date of application with the limit. If it is late, check for sufficient cause and apply the extension layers (Additional/Joint Commissioner, then Commissioner, 30 days each).
- 5Check the ground of cancellation. For non-filing of returns, state that under the proviso to section 30(1) the returns up to the date of cancellation must be furnished with tax, interest, penalty and late fee before revocation is allowed, and test whether this is done.
- 6State the officer's duty: decide within 30 days of the application, by revocation order in REG-22 or by rejection with written reasons after a hearing.
- 7Conclude clearly: revocation allowed, time-barred, not available, or appeal if rejected.
Quickest way: Four-check shortcut
When to use it: Use it for short MCQs and for the first few lines of a written answer.
- Who cancelled? Officer: go on. Self: stop, not revocable.
- Days from service to application: 30 or less is fine.
- If more: up to 30 more days from the Additional/Joint Commissioner, then up to 30 more from the Commissioner, with sufficient cause.
- Returns default? Pending returns and dues must be cleared before revocation is allowed.
- If the officer rejects, the answer is appeal.
Common mistakes in Revocation of Cancellation of Registration
Saying a person whose registration was cancelled on his own application can seek revocation under section 30.
Students remember 'cancellation' and 'revocation' as a pair and skip the 'by the proper officer on his own motion' condition.
Fix: Always ask who initiated the cancellation. Self-cancelled means take a fresh registration.
Counting the 30 days from the effective date of cancellation.
The order may be effective from an earlier date, so students use that date.
Fix: Count from the date of service of the cancellation order.
Stating only one extension of 30 days.
Older notes carried a single extension.
Fix: Remember the amended two-layer extension: Additional/Joint Commissioner up to 30 days, then the Commissioner up to a further 30 days. Total about 90 days.
Ignoring the pending returns condition.
Students treat revocation as a purely procedural application.
Fix: If cancellation was for non-filing of returns, state that the proviso to section 30(1) requires returns up to the date of cancellation to be furnished with all dues before revocation is allowed.
Saying the officer can reject the application without a hearing.
Students focus on the officer's power and forget the natural justice safeguard.
Fix: Rejection needs reasons in writing and an opportunity of being heard.
Advising a fresh REG-21 after rejection.
Students confuse the application stage with the remedy stage.
Fix: After rejection, the remedy is an appeal against the order.
Worked examples
Example 1
Case: Meera Traders, a regular taxpayer, failed to file returns for six continuous months. The proper officer cancelled its registration and the order was served on 10 April. The firm applied for revocation on 25 May, after filing all pending returns and paying tax, interest and late fee. Can the firm get its registration revoked?
Show the solution
- Provision: Under section 30, a person whose registration was cancelled by the proper officer on his own motion can apply for revocation in Form GST REG-21 within 30 days of service of the order.
- Facts: Cancellation was by the officer, so section 30 applies. The order was served on 10 April, so the 30 days ended on 10 May. The application on 25 May is 45 days after service, so it is late.
- Extension: The time can be extended for sufficient cause. The Additional or Joint Commissioner can extend by up to 30 days. 45 days is within that extra 30 days, so the Commissioner's further extension is not needed.
- Condition: Cancellation was for non-filing of returns. Under the proviso to section 30(1), returns up to the date of cancellation must be furnished with the dues before revocation is allowed. The firm has already filed all returns and paid the dues, so this condition is met.
- Officer's action: The officer must decide within 30 days of receipt of the application. If satisfied, he revokes by Form GST REG-22. If he rejects, he must give written reasons after a hearing.
Answer: Yes, the firm can seek revocation. The application is delayed beyond 30 days, so it needs an extension for sufficient cause from the Additional or Joint Commissioner. As the pending returns and dues are cleared, if the extension is granted and the officer is satisfied, he will revoke by REG-22.
Example 2
Case: Rohan, a sole proprietor, closed his trading business and applied for cancellation of his GST registration. The officer cancelled it. Three weeks later, Rohan received a large order and wants the old registration back by applying for revocation. Advise him.
Show the solution
- Provision: Section 30 allows revocation only where the registration was cancelled by the proper officer on his own motion.
- Facts: The cancellation here followed Rohan's own application for cancellation, even though the officer passed the order.
- Application: Since the cancellation was on his own application, section 30 does not give him a right to apply for revocation.
- Way forward: Rohan must apply for a fresh registration and comply with the registration procedure.
Answer: Rohan cannot seek revocation under section 30 because the registration was cancelled on his own application. He should apply for a fresh registration.
Exam tips
- Open every answer by stating who cancelled the registration. Most traps hinge on this.
- Write the numbers cleanly: 30 days to apply, up to 30 plus 30 days of extension, 30 days for the officer to decide.
- In case scenarios, calculate the exact days from the service date and show the working.
- Mention Form GST REG-21 for the application and REG-22 for the revocation order.
- End with the next step: revocation, fresh registration, extension or appeal.

What is the time limit to apply for revocation of cancelled GST registration?
You must apply within 30 days from the date of service of the cancellation order. For sufficient cause, the time can be extended by up to 30 days by the Additional or Joint Commissioner. The Commissioner can then extend by a further period of up to 30 days, for reasons recorded in writing.
How do I apply for revocation of cancellation under Form GST REG-21?
You file Form GST REG-21 on the common portal before the proper officer who cancelled the registration. If the cancellation was for non-filing of returns, the proviso to section 30(1) requires the pending returns up to the date of cancellation to be furnished, with tax, interest, penalty and late fee, before revocation is allowed. The officer then decides within 30 days of the application.
Can registration cancelled on own application be revoked under GST?
No. Section 30 covers only registrations cancelled by the proper officer on his own motion. If you cancelled on your own application and want to resume business, you need a fresh registration.
What if the officer rejects my revocation application?
The officer must record reasons in writing and give you an opportunity of being heard before rejecting. If he rejects, you can file an appeal against the order under the appeal provisions of the Act.
