Collection, Recovery and Refund of Tax: CMA Final Paper 15 Guide
This chapter covers how tax reaches the government before and after assessment: deduction or collection at source, advance payment, self-assessment, penal consequences of default, recovery by the Tax Recovery Officer, and refunds with interest. Solve problems by finding the mode of payment, the rate, the due date, the shortfall and the months of default.
What this chapter covers
This chapter is about how tax is actually paid, chased and returned. Under the Income-tax Act, 2025, section 390 says tax on income is payable by deduction or collection at source, by advance payment, or by payment under section 392(2)(a). It is payable even if the assessment for that income happens in a later tax year. Tax deducted, collected or paid is treated as paid on behalf of the person whose income it is.
The chapter then follows the life of a tax demand. First comes payment during the year (TDS, TCS, advance tax). Then comes the return stage, where self-assessment under section 266 requires you to pay balance tax, interest and fee before furnishing the return, after taking credit for advance tax, TDS and TCS, and foreign tax relief. If the person defaults, interest, fee, penalty and the assessee-in-default status follow. If the tax is still unpaid, the Tax Recovery Officer recovers it. If too much was paid, you get a refund with interest.
This chapter connects to almost every other part of Paper 15. Income computation, set-off and deductions give you the total income and tax. This chapter tells you how much of that tax was already paid, how much is still due, and what the interest cost is. International taxation links in through foreign tax credit, which reduces the tax payable at self-assessment. Always check the current wording of sections in the Act before the exam, because section references were amended with effect from 1 April 2026.
This chapter gives you steady marks because it mixes rule-based theory with small numerical workings. An MCQ can ask for the interest period or the tax credit adjusted under self-assessment. A descriptive question can give a case where TDS was not deducted and ask for the consequences. The workings are short and mechanical, so careful practice converts directly into marks. It also makes your computation answers stronger, since the final tax payable or refund line depends on the rules here.
Collection, Recovery and Refund of Tax: topics in the order to study them
- 1Tax Deduction and Collection at Source (TDS/TCS)It is the largest topic and the first mode of payment in section 390, so every later topic builds on it.
- 2Advance Payment of TaxIt is the second mode of payment and introduces assessed tax, which you need for interest and self-assessment.
- 3Consequences of Default in Deduction and PaymentYou can only judge default once you know what had to be deducted, collected or paid and by when.
- 4Recovery of Tax and Tax Recovery OfficerRecovery is the next step when a demand stays unpaid after default.
- 5Refunds and Interest on RefundsIt closes the cycle: it applies when payments exceed the tax finally due, and it is easier once you know how credits are counted.
How to prepare Collection, Recovery and Refund of Tax
Treat this chapter as a flow from payment to default to recovery to refund. Learn the sequence first, then fill in rates, dates and conditions.
- Read section 390 and draw the three modes of payment on one page. Note that tax paid is treated as paid on behalf of the person whose income it is.
- Make a TDS/TCS table for the payment types you study: payer, nature of payment, threshold, rate and due date. Check each entry against the current Act and rules before you rely on it.
- Learn the advance tax structure and the meaning of assessed tax. Under section 424, assessed tax is the tax on total income less TDS, TCS, foreign tax relief and listed tax credits.
- Practise interest workings. Use simple interest at 1% for every month or part of a month, and count a part month as a full month. Check which section and which shortfall base applies.
- Practise self-assessment under section 266. List the credits first, then compute the balance, then the interest and fee. Remember that a short payment is adjusted first to fee, then interest, then tax.
- Write short answers on default, recovery and refund as steps: trigger, authority, consequence. Practise them in 5 to 6 lines each.
- Solve past MCQs and case questions, then redo the ones you got wrong after a week.
Common mistakes in Collection, Recovery and Refund of Tax
Treating the 1% interest as charged per year or per day.
Fix: Remember the wording: 1% for every month or part of a month, simple interest. Count months, and count a part month as one full month.
Applying the interest on the whole tax instead of assessed tax or the shortfall.
Fix: First compute assessed tax. Use all of it if no advance tax was paid. Otherwise use only the shortfall.
Missing the 90% test for advance tax.
Fix: Compare advance tax paid with 90% of assessed tax before deciding whether interest applies.
Adjusting a part payment under self-assessment to tax first.
Fix: Adjust first to fee, then interest, then tax, as section 266(3) sets out.
Using old section numbers from the Income-tax Act, 1961.
Fix: Write the Income-tax Act, 2025 numbers or describe the rule in words. Note that section references were amended from 1 April 2026.
Giving a theory answer on default without naming the trigger and the consequence.
Fix: Use three parts: what default occurred, who acts, and what follows. Apply this to the facts of the case.

- Failure to pay the whole amount under self-assessment makes the person an assessee in default for the unpaid amount.

- Section 424 applies if advance tax is not paid, or is less than 90% of assessed tax.

Collection, Recovery and Refund of Tax: frequently asked questions
Is this chapter more theory or numerical?
It is both. TDS and TCS rules, default consequences, recovery and refunds are theory-heavy. Advance tax interest and self-assessment are short numerical workings. Prepare both.
Which Act should I follow for this chapter?
For the June 2027 term, use the Income-tax Act, 2025, which governs income from 1 April 2026 (tax year 2026-27). Do not quote section numbers from the Income-tax Act, 1961.
How do I calculate interest for not paying advance tax?
First find assessed tax, which is tax on total income less TDS, TCS, foreign tax relief and listed credits. If no advance tax was paid, interest is 1% per month or part of a month on the whole assessed tax. If advance tax paid is below 90% of assessed tax, it is charged on the shortfall.
What happens if I pay less than the self-assessment tax due?
The amount paid is adjusted first to fee, then to interest, and the balance to tax. Any unpaid tax, interest or fee makes you an assessee in default for that amount.
