Amendment of Registration under Section 28 of the CGST Act

Updated 10 October 2026 · Fact-checked

Under Section 28 of the CGST Act, a registered person must report any change in registration details. Rule 19 requires FORM GST REG-14 within fifteen days of the change. Changes to legal name, address or key persons need officer approval in FORM GST REG-15. Other changes take effect on submission.

Understand Amendment of Registration

A GST registration records facts about your business: its name, address, partners or directors, bank details, goods and services and so on. When any of these facts change, the record on the common portal must change too.

Section 28(1) puts the duty on every registered person (and on a person holding a Unique Identity Number) to inform the proper officer of any change in the information furnished at registration or later. The form, manner and time are as prescribed. The prescribed rule is Rule 19 of the CGST Rules, 2017.

Section 28(2) gives the proper officer power to approve or reject amendments. The first proviso says approval is not needed for particulars that are prescribed. Rule 19(1)(c) gives effect to this: for particulars other than those in clause (a), the certificate stands amended on submission of the application, and no approval is needed. The second proviso says the officer cannot reject an application without giving you a chance to be heard. Section 28(3) says an approval or rejection under the State GST or UTGST Act is deemed to be one under the CGST Act.

The Rules split changes into two groups. Many students call them core and non-core fields. These words are common in practice and on the portal, but the Rule itself does not use them. It simply lists three changes in clause (a) of the first proviso to Rule 19(1), and treats everything else as a change under clause (c). Learn this split well. It decides whether an officer must approve the change.

Key rules to remember

Duty to inform (Section 28(1))
Change in registration particulars → inform proper officer in the prescribed form, manner and time
Applies to every registered person and to a person with a Unique Identity Number.
Time limit (Rule 19(1))
Application in FORM GST REG-14 within 15 days of the change, with documents
Signed or verified through electronic verification code, filed on the common portal directly or through a notified Facilitation Centre.
Core fields (Rule 19(1), proviso clause (a))
Legal name of business | Address of principal or additional place(s) of business | Addition, deletion or retirement of partners, directors, Karta, Managing Committee, Board of Trustees, CEO or equivalent responsible for day-to-day affairs
Applies only where the change does not warrant cancellation under section 29. Officer approves after due verification.
Officer approval for core fields
Approval within 15 working days of receiving FORM GST REG-14, by order in FORM GST REG-15
The proviso to clause (a) gives effect from the date of the event. But Rule 19(1A) says no particular stands amended from a date earlier than the date of submission of FORM GST REG-14, unless the Commissioner orders otherwise for reasons recorded in writing. So the effect cannot precede the submission date.
Non-core fields (clause (c))
Any other particular → certificate stands amended upon submission of FORM GST REG-14
No approval is needed for the change to take effect.
Same PAN rule (clause (b))
Change of legal name or of partners/directors etc. in one State or UT applies to all registrations on the same PAN
Address changes are not covered by this clause.
Change of PAN (clause (d))
Change in the constitution of a business that results in a change of PAN → apply for fresh registration in FORM GST REG-01
This applies only where a change in constitution changes the PAN. Amendment is not the route in that case.
Show cause and rejection (Rule 19(2) to (4))
Notice in FORM GST REG-03 within 15 working days; reply in FORM GST REG-04 within 7 working days; rejection by order in FORM GST REG-05
The notice itself gives 7 working days to show cause. Rejection follows if the reply is unsatisfactory or none is filed.
Deemed approval (Rule 19(5))
No action within 15 working days of application, or within 7 working days of receiving the reply → certificate stands amended
The amended certificate is made available on the common portal.
No retrospective effect (Rule 19(1A))
Notwithstanding Rule 19(1), no particular is amended from a date earlier than submission of FORM GST REG-14
This applies to core and non-core changes alike. Exception: an order of the Commissioner for reasons recorded in writing, on conditions he specifies.

How to solve Amendment of Registration questions

Use this order for any question on amendment of registration. It keeps your answer in the format examiners reward.

  1. 1Identify the change in the facts: what particular has changed and on what date.
  2. 2Classify it. Is it legal name, address of a place of business, or a change in partners, directors or similar persons, and does the change not warrant cancellation under section 29? Then it falls under clause (a). Any other particular falls under clause (c). Separately, if a change in the constitution of the business results in a change of PAN, fresh registration is needed (clause (d)).
  3. 3State the duty: Section 28(1) and Rule 19(1) require FORM GST REG-14 with documents within fifteen days of the change.
  4. 4Apply the approval rule. For clause (a), the officer approves after verification within fifteen working days by FORM GST REG-15. For clause (c), the certificate stands amended on submission.
  5. 5Fix the effective date. For clause (a), the proviso speaks of the date of the event. But Rule 19(1A) begins 'Notwithstanding anything contained in sub-rule (1)' and bars an effective date earlier than the date of submission of FORM GST REG-14, unless the Commissioner orders otherwise for reasons recorded in writing. So the effect cannot precede the submission date. For clause (c), the certificate stands amended upon submission, and Rule 19(1A) again bars an earlier date.
  6. 6Cover the rejection path if relevant: notice in FORM GST REG-03, reply in FORM GST REG-04 within seven working days, order in FORM GST REG-05, and the right to be heard under Section 28(2).
  7. 7Cover deemed approval if the officer is silent (Rule 19(5)).
  8. 8Write a one-line conclusion that answers exactly what was asked.

Quickest way: Three-question check for amendment problems

When to use it: Use it for MCQs and for short written parts where you have under two minutes.

  1. Ask: is the change in name, address or key persons, and does it not warrant cancellation under section 29? If yes, officer approval is needed, in FORM GST REG-15. The effect cannot date from before submission of FORM GST REG-14 (Rule 19(1A)), unless the Commissioner orders otherwise in writing.
  2. If no, the certificate is amended on submission of FORM GST REG-14, and the effect cannot date from before submission.
  3. Ask: does a change in constitution change the PAN? If yes, the answer is fresh registration in FORM GST REG-01.
  4. Remember the numbers: 15 days to apply, 15 working days for the officer, 7 working days for the reply, and 7 working days for the officer to act after the reply, failing which the certificate stands amended (Rule 19(5)(b)).

Common mistakes in Amendment of Registration

  • Treating all changes as needing officer approval.

Students remember Section 28(2) and forget that Rule 19 splits changes into two groups.

Fix: Only the three changes in clause (a), and only where the change does not warrant cancellation under section 29, need approval. Every other change takes effect when FORM GST REG-14 is submitted.

  • Mixing days and working days.

The rule uses both: fifteen days for the taxpayer, fifteen working days for the officer.

Fix: Write the unit every time. Taxpayer: 15 days from the change. Officer: 15 working days from receipt of the application.

  • Saying a non-core amendment can be backdated to the date of change.

Students carry the clause (a) effective date over to all changes.

Fix: Under Rule 19(1A), no particular is amended from a date earlier than submission of FORM GST REG-14, unless the Commissioner orders it for reasons recorded in writing.

  • Advising amendment when the change of constitution changes the PAN.

The word 'change' makes students think of FORM GST REG-14 automatically.

Fix: If the change in constitution results in a change of PAN, the person must apply for fresh registration in FORM GST REG-01.

  • Applying an address change in one State to all registrations of the same PAN.

Clause (b) covers only legal name and the persons in clause (a)(iii), but students read it as covering the whole of clause (a).

Fix: Clause (b) applies to sub-clauses (i) and (iii) only. Address is not included.

  • Forgetting the right to be heard.

Students write only the rejection order and skip the safeguard.

Fix: Mention that the officer cannot reject without giving the person an opportunity of being heard (Section 28(2), second proviso), and that Rule 19(2) provides a show cause notice.

Worked examples

Example 1

Sharma Traders Pvt. Ltd., a registered company in Pune, appoints a new director on 10 March. On 20 March it files FORM GST REG-14. Is the filing in time, does the amendment need officer approval, and from when does it take effect?

Show the solution
  1. The change is the addition of a director. This falls under Rule 19(1), first proviso, clause (a)(iii).
  2. Time limit: fifteen days from 10 March ends on 25 March. Filing on 20 March is in time.
  3. Approval: the proper officer must, after due verification, approve within fifteen working days of receipt of the application and issue an order in FORM GST REG-15.
  4. Effective date: the proviso to clause (a) speaks of the date of the event, which is 10 March. But Rule 19(1A) begins 'Notwithstanding anything contained in sub-rule (1)' and bars any amendment from a date earlier than submission of FORM GST REG-14. So the amendment cannot take effect from a date earlier than 20 March, unless the Commissioner orders otherwise for reasons recorded in writing.
  5. Per clause (b), if the company holds other registrations on the same PAN in other States or Union territories, the change applies to them too.

Answer: The filing is in time. Officer approval is required (FORM GST REG-15 within 15 working days). The amendment cannot take effect from a date earlier than 20 March, the date of submission, unless the Commissioner orders otherwise in writing. If the company has other registrations on the same PAN, the change applies to them too.

Example 2

Mehta & Co., a registered person, changes its bank account details on 5 April and files FORM GST REG-14 on 12 April. The officer takes no action. Explain the position on approval and effective date.

Show the solution
  1. A bank account change is not legal name, address or key persons. It falls under clause (c).
  2. Under clause (c), the certificate of registration stands amended upon submission of FORM GST REG-14 on the common portal. Officer approval is not needed.
  3. Effective date: submission on 12 April. Under Rule 19(1A) the amendment cannot be effective from 5 April, unless the Commissioner passes an order for reasons recorded in writing.
  4. The officer's inaction does not matter. Even otherwise, Rule 19(5) deems the certificate amended if no action is taken within fifteen working days.

Answer: No officer approval is needed. The certificate stands amended from 12 April, the date of submission. It cannot be backdated to 5 April without the Commissioner's order.

Exam tips

  • In MCQs, the favourite traps are the 15 days versus 15 working days and the 7 working days for reply. Read the unit carefully.
  • Write the form numbers: REG-14 (application), REG-15 (approval), REG-03 (notice), REG-04 (reply), REG-05 (rejection). They earn easy step marks.
  • Always state the section and rule together: Section 28 of the CGST Act and Rule 19 of the CGST Rules.
  • In a case-based question, classify the change first. The classification decides approval and effective date.
  • If the facts mention a change of constitution, check at once whether the PAN changes.

Amendment of Registration: frequently asked questions

What are core and non-core fields in GST registration amendment?

Core fields are the particulars listed in clause (a) of the first proviso to Rule 19(1): legal name, address of place(s) of business, and key persons such as partners or directors. All other particulars are non-core. The Rule does not use the words core and non-core. They are a common way of describing the split.

How soon must I amend my GST registration after a change?

You must submit FORM GST REG-14 with supporting documents within fifteen days of the change. The application is made on the common portal, directly or through a notified Facilitation Centre.

Does an amendment of non-core fields need officer approval?

No. For particulars other than those in clause (a), the certificate of registration stands amended upon submission of FORM GST REG-14 on the common portal.

What happens if the officer does not act on my amendment application?

If the officer takes no action within fifteen working days of submission, or within seven working days of receiving your reply to a notice, the certificate stands amended to the extent applied for. The amended certificate is made available on the common portal.
