Incomes Not Included in Total Income under Section 11
Updated 11 October 2026 · Fact-checked
Section 11 of the Income-tax Act, 2025 says that incomes listed in Schedules II to VI are left out of total income, but only if the conditions in those Schedules are met. Schedule VII does the same for listed persons. If conditions fail, the income or person is taxed normally.
Understand Incomes Not Included in Total Income (Section 11)
Total income is the amount on which tax is computed. Not every receipt goes into it. The Act lists some incomes that are kept out. Section 11 is the gateway provision that gives this relief.
Under the 2025 Act, the list is not in the section itself. The section points to Schedules. Incomes in Schedules II, III, IV, V and VI are not included in total income, subject to the conditions given there. Separately, the persons listed in Schedule VII are not chargeable to tax on total income, again subject to conditions.
The key word is conditions. Section 11(2) says that if the conditions for an income in those Schedules are not satisfied in a tax year, the income is charged to tax on the total income for that year. Section 11(4) says the same for persons in Schedule VII. So an exemption is never automatic. You must check the condition for the specific item and the specific year.
Section 11(5) lets the Central Government make rules or issue notifications for the purposes of the section, as specified in the Schedules. So some exemptions depend on a rule or notification being in place.
In the exam, think of two questions. First: is this an income exempt in the Schedules, or is it a person exempt in Schedule VII? Second: are the conditions met in this tax year? Your answer then follows the usual ICSI pattern: provision, analysis of facts, conclusion.
Key rules to remember
- Exclusion of listed incomes
- Section 11(1): income in Schedules II, III, IV, V, VI is not included in total income, subject to the conditions specified therein
- The condition is part of the rule. Without it, the exclusion does not apply.
- Failure of conditions for incomes
- Section 11(2): conditions not satisfied in a tax year → that income is charged to tax on the total income for that year
- The loss of exemption applies for that tax year only, for the income concerned.
- Persons not chargeable
- Section 11(3): persons in Schedule VII, subject to conditions, are not chargeable to tax on total income for a tax year
- This is about the person, not a single item of income.
- Failure of conditions for persons
- Section 11(4): conditions of Schedule VII not satisfied → income of that person is charged to tax for that tax year
- The whole income is taxed under the Act's provisions.
- Power to make rules
- Section 11(5): Central Government may make rules or issue notifications as specified in Schedules II to VII
- Check whether an exemption needs a notification.
How to solve Incomes Not Included in Total Income (Section 11) questions
Use this method for any question asking whether an income is included in total income.
- 1Identify the receipt and the person who received it, and note the tax year.
- 2Decide whether the question is about an item of income (Schedules II to VI, section 11(1)) or about the person (Schedule VII, section 11(3)).
- 3State the rule in plain words: listed income is excluded, subject to the conditions in the Schedule.
- 4List the conditions for that item from the facts given, and test each one against the facts.
- 5If every condition is met, exclude the income from total income. If any is not met, apply section 11(2) or 11(4) and treat it as taxable.
- 6Check if a rule or notification is needed under section 11(5), and mention it if the facts refer to one.
- 7Write a clear conclusion with the amount included in or excluded from total income.
Quickest way: Rule-condition-conclusion check
When to use it: Use it for short-answer or case-based questions when time is tight.
- Write one line: section 11 excludes listed income only if conditions are met.
- Name the Schedule group: II to VI for income, VII for persons.
- Tick off each condition from the facts in one line each.
- Write the conclusion: excluded, or taxable under section 11(2) or 11(4).
- If amounts are given, show the figure removed from or kept in total income.
Common mistakes in Incomes Not Included in Total Income (Section 11)
Treating every listed exemption as unconditional.
Students memorise the list of exempt items and forget the words 'subject to conditions'.
Fix: For each exempt item, always write its condition. If the facts break it, apply section 11(2).
Mixing up exempt incomes with exempt persons.
Both sound like 'exemption', but sections 11(1) and 11(3) work differently.
Fix: Ask first: is the exemption on an income (Schedules II to VI) or on a person (Schedule VII)?
Saying the entire exemption is lost forever when a condition fails.
The wording on charging to tax is read too broadly.
Fix: The text speaks of 'that tax year'. Test conditions year by year.
Quoting section numbers for items inside the Schedules without being sure.
Students try to recall item numbers from memory.
Fix: Cite section 11 and the Schedule group. Name the item in words unless you are certain of its entry.
Citing the old Act's section 10 as the exemption provision.
Many books and notes still use the Income-tax Act, 1961.
Fix: For June 2027, write section 11 of the Income-tax Act, 2025, and use the Schedule structure.
Worked examples
Example 1
A resident individual received an income which is listed in one of Schedules II to VI. One condition specified for that income was not satisfied in the tax year. Can the individual exclude it from total income under section 11?
Show the solution
- Provision: section 11(1) excludes income enumerated in Schedules II, III, IV, V and VI from total income, subject to the conditions specified in them.
- Facts: the income is listed, but one condition is not met in the tax year.
- Analysis: section 11(2) says that when conditions are not satisfied in a tax year, the income is charged to tax under the Act on the total income for that year.
- The exclusion depends on every condition, so one failed condition is enough to lose it.
Answer: No. The income is not excluded for that tax year. It is included in total income and charged to tax under section 11(2).
Example 2
A person is enumerated in Schedule VII and satisfies all the conditions specified there for the tax year. Another person, also enumerated in Schedule VII, fails the conditions in the same year. State the tax position of both.
Show the solution
- Provision: section 11(3) says persons in Schedule VII are not chargeable to tax on total income for a tax year, subject to fulfilment of the specified conditions.
- First person: all conditions are met, so the person is not chargeable to tax on total income for that year.
- Second person: section 11(4) applies, since the conditions are not satisfied in that year.
- Under section 11(4), the income of that person is charged to tax under the provisions of the Act for that tax year.
Answer: The first person is not chargeable to tax on total income for the year. The second person's income is charged to tax for that year under section 11(4).
Exam tips
- Begin every answer with the provision: section 11 and the Schedule group (II to VI for incomes, VII for persons).
- Always write the condition and show that you tested it against the facts. Examiners look for this step.
- Use the consequence wording from sections 11(2) and 11(4): the income is charged to tax for that tax year.
- Do not use the Income-tax Act, 1961 section numbers in June 2027 answers, except when you are asked to contrast the Acts.
- End with a one-line conclusion stating whether the income is excluded or taxed.

What does section 11 of the Income-tax Act, 2025 do?

The exemption is lost for that tax year. Under section 11(2), the income is charged to tax on the total income for that year. For Schedule VII persons, section 11(4) gives the same result.
Is agricultural income exempt under section 11?
Section 11 only gives the framework and points to the Schedules. Whether agricultural income is excluded depends on its entry and conditions in the Schedules. Check the Schedule entry in your study material before you state it in an answer.
How do I claim exempt income in my return?
Exempt income is shown in the return in the part meant for it, and it stays outside total income. Make sure the conditions of the relevant Schedule are met for that tax year. Keep documents that prove each condition.
