Computation of Total Income of Individuals and HUF

Updated 11 October 2026 · Fact-checked

Computation of total income means adding income under each head, applying clubbing, setting off and carrying forward losses, and allowing deductions to reach total income. Then you apply the rate. Under section 202 of the Income-tax Act, 2025 the new regime is the default unless you opt out. Follow the same sequence every time.

Understand Computation of Total Income of Individuals and HUF

Total income is the figure on which tax is charged. You build it in a fixed order: decide the residential status, compute income under each head, club income of other persons where the law says so, set off losses, and then allow deductions.

Residential status decides what is taxable in India. A resident is taxed on global income. A non-resident is taxed on income received in India or accruing or arising in India. Always settle this first, because it decides which incomes enter the computation.

For individuals, HUFs and certain other persons, section 202 gives a default new tax regime. Tax is computed on the slab table in that section unless the person exercises the option under section 202(4). Under the new regime, many exemptions and deductions are not allowed. The list is in section 202(2), and it also bars set-off of house property loss against other heads.

Loss rules are strict. A loss from a speculation business can be set off only against profits of another speculation business (section 113). A loss from a specified business under section 46 can be set off only against profits of another specified business (section 114). A loss from owning and maintaining race horses can be set off only against income from that activity (section 115). Unabsorbed losses under these sections are carried forward and set off in later years under the same restriction.

In an exam, you are given facts and must show the provision, the analysis and the conclusion. Show each head separately, state why an item is included or excluded, and then give the total income.

Key rules to remember

Total income (structure)
Total income = Gross total income − deductions allowed
Gross total income is the sum of income under all heads after clubbing and after set-off of current-year losses. Deductions are restricted under the new regime by section 202(2).
New regime slabs (section 202(1))
Up to ₹4,00,000: Nil | ₹4,00,001 to ₹8,00,000: 5% | ₹8,00,001 to ₹12,00,000: 10% | ₹12,00,001 to ₹16,00,000: 15% | ₹16,00,001 to ₹20,00,000: 20% | ₹20,00,001 to ₹24,00,000: 25% | Above ₹24,00,000: 30%
Applies to an individual, HUF, AOP (not a co-operative society), BOI and certain artificial juridical persons, unless the option under section 202(4) is exercised. Surcharge, cess and any rebate are separate and not in the text supplied.
Option out of the new regime (section 202(4))
Business or profession income: opt on or before the return due date under section 263(1); once exercised it continues; withdrawal allowed only once; after withdrawal, never again unless business income ceases. No business income: opt along with the return.
The option is made in the prescribed manner for the tax year.
Speculation loss (section 113)
Set off only against speculation business profits; carry forward for not more than four succeeding tax years
The four-year limit counts from the tax year after the loss was first computed.
Specified business loss (section 114)
Set off only against profits of another specified business; carried forward to following years
The text supplied for section 114 contains no time limit.
Race horse activity loss (section 115)
Set off only against income from owning and maintaining race horses; carry forward not more than four succeeding tax years
Loss means stake money falling short of revenue expenditure on maintaining the horses.

How to solve Computation of Total Income of Individuals and HUF questions

Use this sequence for any individual or HUF computation question.

  1. 1Fix the residential status from the facts and note which incomes are taxable in India.
  2. 2Identify which regime applies: default section 202, or the option under section 202(4) if the question says it is exercised.
  3. 3Compute income head by head: salary, house property, business or profession, capital gains, other sources. Give a reason for each inclusion or exclusion.
  4. 4Apply clubbing provisions where the facts show income of a spouse, minor child or others being taxed in the assessee's hands.
  5. 5Set off current-year losses within and across heads, then carry forward the balance. Apply the restricted-set-off rules for speculation, specified business and race horse losses.
  6. 6Allow only the deductions available under the regime applied. Under section 202(2) many are barred.
  7. 7Arrive at total income, round as the question requires, and apply the slab rates.
  8. 8Add surcharge and cess only if the question gives the rates, and state the final conclusion clearly.

Quickest way: Head-wise table and regime check

When to use it: Use when time is short and the question has many income items.

  1. Write the five heads as a list and drop each item under its head in one pass.
  2. Strike out items the new regime does not allow, using the section 202(2) list.
  3. Mark each loss with its set-off restriction before you net anything.
  4. Compute tax by slab in a column: tax on each band, then add.
  5. Write one line of conclusion with the total income and the tax.

Common mistakes in Computation of Total Income of Individuals and HUF

  • Setting off a speculation loss against salary or other business income.

Students treat all business losses alike.

Fix: Under section 113(1), a speculation loss goes only against profits of another speculation business. Carry the rest forward.

  • Claiming old-regime deductions while computing under the default regime.

Habit from earlier study, and the regime is not checked first.

Fix: Check section 202 at the start. If no option is exercised under section 202(4), apply the section 202(2) restrictions.

  • Setting off a house property loss against salary under the new regime.

Students remember set-off across heads as a general rule.

Fix: Section 202(2)(b)(ii) bars set-off of a house property loss against any other head under the new regime.

  • Carrying forward a speculation or race horse loss beyond four years.

Confusion with rules for other losses.

Fix: Sections 113(3) and 115(3) allow carry forward for not more than four tax years immediately succeeding the year the loss was first computed.

  • Treating the option under section 202(4) as a free yearly choice for a person with business income.

Students assume the choice is available every year.

Fix: For business or profession income, the option once exercised applies to later years, may be withdrawn only once, and after withdrawal is generally not available again.

  • Skipping residential status and taxing all foreign income.

Rushing to the heads of income.

Fix: State the residential status first and include only the incomes taxable for that status.

Worked examples

Example 1

Rahul Mehta, a resident individual, has no business income and does not exercise any option under section 202(4). His total income for the tax year is ₹14,00,000. Compute income-tax on the slabs in section 202(1), before surcharge, cess and any rebate.

Show the solution
  1. Because he does not opt out, the default slab table in section 202(1) applies.
  2. Up to ₹4,00,000: Nil.
  3. ₹4,00,001 to ₹8,00,000 is ₹4,00,000 at 5% = ₹20,000.
  4. ₹8,00,001 to ₹12,00,000 is ₹4,00,000 at 10% = ₹40,000.
  5. ₹12,00,001 to ₹14,00,000 is ₹2,00,000 at 15% = ₹30,000.
  6. Total = ₹20,000 + ₹40,000 + ₹30,000 = ₹90,000.

Answer: Income-tax before surcharge, cess and rebate is ₹90,000.

Example 2

Meena Iyer, a resident individual, has the following for the tax year: speculation business loss ₹1,50,000; profit from another speculation business ₹60,000; business profit from non-speculative trading ₹4,00,000. Advise on set-off and carry forward, and state her business income after set-off.

Show the solution
  1. Under section 113(1), the speculation loss can be set off only against profits of another speculation business.
  2. Set off ₹60,000 against the speculation profit. Speculation income becomes nil.
  3. The unabsorbed loss is ₹1,50,000 − ₹60,000 = ₹90,000.
  4. It cannot be set off against the ₹4,00,000 non-speculative profit.
  5. Under section 113(2) and (3), carry forward ₹90,000 to the following tax year, to be set off only against speculation profits, for not more than four succeeding tax years.
  6. Business income for the year is ₹4,00,000 (speculation nil plus non-speculative ₹4,00,000).

Answer: Business income is ₹4,00,000. A speculation loss of ₹90,000 is carried forward for up to four succeeding tax years, against speculation profits only.

Exam tips

  • Start every answer with the regime and residential status. Examiners look for this first.
  • Quote the section number for each restriction you apply, but only when you are sure of it.
  • Write provision, analysis and conclusion for each issue, as the paper is case-based.
  • Show slab-wise tax in a small list so marks are earned even if the final figure slips.
  • State clearly which losses are carried forward and any time limit.
