A State Legislature dissolves a Zila Panchayat before its five-year term ends because of alleged mismanagement. The State proposes to hold elections whenever convenient, even after eight months. Under the constitutional scheme, what is the correct position?

Elections to a Panchayat dissolved prematurely must be completed within six months from the date of dissolution. A proposed delay of eight months would contravene the constitutional requirement, and the new body serves only the unexpired period of the original five-year term.

  1. AElection must be completed before expiry of six months from the date of dissolutionCorrect
  2. BElection can be held any time within two years of dissolution
  3. CElection is at the discretion of the Governor with no time limit
  4. DElection must be held within one month of dissolution

Explanation

Part IX requires that when a Panchayat is dissolved before its term, elections must be completed within six months of dissolution. Eight months therefore violates the rule. The body formed after such dissolution continues only for the remainder of the original term.
