After the Registrar registers a charge, to whom must the certificate of registration be issued?
The Registrar issues the certificate of registration to the company and, as the case may be, to the person in whose favour the charge is created. It is not limited to only the company or only the lender, and it is not sent to a liquidator.
- ATo the company and, as the case may be, the person in whose favour the charge is createdCorrect
- BOnly to the charge-holder
- COnly to the company
- DTo the liquidator of the company
Explanation
On registration, the Registrar issues a certificate of registration in the prescribed form and manner to the company and, as the case may be, to the person in whose favour the charge is created. Limiting it to one party is incorrect because both are covered.
