CS Executive · Setting Up of Business, Industrial and Labour Laws · Conversion of Business Entities

After the Tribunal sanctions the re-conversion of a Producer Company to a multi-State co-operative society, within what period must it apply for registration under the Multi-State Co-operative Societies Act, 2002, and to whom must it file a report?

The company must apply within six months of the Tribunal's sanction and file a report with the Tribunal, the Registrar of Companies and the Registrar of the Co-operative Societies under which it is registered. Section 378ZS(8) sets this requirement, so shorter periods or fewer recipients are incorrect.

  1. AWithin three months, reporting only to the Registrar of Companies
  2. BWithin six months of sanction, reporting to the Tribunal, the Registrar of Companies and the relevant co-operative RegistrarCorrect
  3. CWithin one year, reporting only to the Tribunal
  4. DWithin six months, reporting only to the Registrar of Co-operative Societies

Explanation

Section 378ZS(8) requires application within six months of the Tribunal's sanction and a report filed to the Tribunal, the Registrar of Companies and the Registrar of the Co-operative Societies under which it is registered. The other options give wrong periods or omit recipients.
