CS Executive · Setting Up of Business, Industrial and Labour Laws · The Labour Laws (Simplification of Procedure for Furnishing Returns and Maintaining Registers by Certain Establishments) Act

Anand Engineering, a small establishment, keeps its Form II and Form III registers on a computer, and emails Form I to an Inspector whose office has facility to receive email. During an inspection, the Inspector asks to see the registers. What must the employer do?

The employer must make a printout of the electronic registers, or the relevant portion, available to the Inspector on demand. The Act allows electronic maintenance, but inspection rights under the Scheduled Acts continue to apply.

  1. ANothing, because electronic registers are exempt from inspection
  2. BConvert all records to physical form permanently
  3. CMake a printout of the registers or the relevant portion available to the Inspector on demandCorrect
  4. DObtain written permission from the Central Government before showing them

Explanation

Registers and returns may be kept in physical or electronic form. If kept electronically, the proviso to section 4(2) requires a printout, or a portion of it, to be made available to the Inspector on demand. Form I may also be emailed if the authority can receive email. Permanent conversion to paper is not required.
