CS Executive · Setting Up of Business, Industrial and Labour Laws · The Apprentices Act, 1961

Anita completed institutional training in a school recognised by the National Council and passed the trade test conducted by that Council. Her employer, Bharat Auto Ltd in Gujarat, is fixing the period of her apprenticeship training. According to section 6 of the Apprentices Act, 1961 (central text), how is that period determined?

The period is such as may be prescribed and must be specified in the contract of apprenticeship. After the 2014 amendment it is no longer determined by the National Council. State Council fixation applies only under certain state amendments, not in the central text.

  1. AIt is determined by the National Council in each case
  2. BIt is such as may be prescribed, and it must be specified in the contract of apprenticeshipCorrect
  3. CIt is fixed by the State Apprenticeship Council
  4. DIt is fixed by mutual agreement between the employer and the apprentice

Explanation

Section 6 states that the training period shall be specified in the contract of apprenticeship, and for trade apprentices under clause (a) it shall be such as may be prescribed. The words 'determined by that Council' were substituted by 'prescribed' in 2014. State Council fixation appears only in Maharashtra and Rajasthan amendments for other apprentices, and Gujarat has no such amendment.
