Arjun Gadgets imports goods by courier. The authorised courier presents the list of particulars of the goods to the proper officer on 8 August. The courier's consignment had arrived on 5 August, and the importer paid duty on 9 August. The tariff value was notified at a different level on 7 August. Which date governs the tariff value for this import?

The tariff value in force on 8 August applies. Under section 83(1), for goods imported by courier the relevant date is when the authorised courier presents the list containing particulars to the proper officer, rather than arrival, notification or duty payment dates.

  1. A5 August, the date of arrival of the consignment
  2. B7 August, the date of the notification
  3. C8 August, the date the list of particulars is presented to the proper officerCorrect
  4. D9 August, the date of payment of duty

Explanation

Section 83(1) provides that the rate and tariff value for goods imported by post or courier are those in force on the date the postal authorities or authorised courier present the list of particulars to the proper officer. That is 8 August. Section 15 does not apply to goods imported by post.
