Bharat Steels Ltd, Jamshedpur, has a lawful strike in progress. While it continues, the workers' union decides to extend it further. A worker asks whether fresh notice of strike must be given because the strike is already in existence. Under the Industrial Relations Code, 2020, what is correct?

No fresh notice is needed when a strike already exists. The Industrial Relations Code, 2020 dispenses with notice in that case, but the employer must send intimation on the day the strike is declared to the authority specified by the appropriate Government.

  1. AFresh notice is required every fourteen days
  2. BNotice is required, but only sixty days after the strike began
  3. CNotice is unnecessary where a strike already exists, though the employer sends intimation of the strike on the day it is declared to the specified authorityCorrect
  4. DNotice is unnecessary and the employer has no intimation duty

Explanation

The Code says notice of strike or lock-out is not needed where a strike or lock-out already exists. However, the employer must send intimation on the day it is declared to the authority specified by the appropriate Government. So option three states both parts.
