CertSafe Ltd., an intermediary, deliberately refuses to give technical assistance to a Government agency authorised to monitor and collect traffic data for cyber security. As amended in 2023, what is the maximum consequence for such intentional contravention?
An intermediary that intentionally or knowingly refuses technical assistance under Section 69B faces imprisonment up to one year or a fine up to one crore rupees, or both. The earlier three years plus fine wording was replaced in 2023.
- AImprisonment up to three years and also fine
- BImprisonment up to one year or fine up to one crore rupees, or bothCorrect
- CFine up to one lakh rupees only
- DImprisonment up to one year and a compulsory fine of one crore rupees
Explanation
Section 69B(4), as substituted by Act 18 of 2023, provides imprisonment up to one year or fine up to one crore rupees, or both. The older wording of three years and also fine was replaced. The 'and compulsory fine' option wrongly makes the fine mandatory.
