CS Professional · Labour Laws and Practice · The Labour Laws (Simplification of Procedure for Furnishing Returns and Maintaining Registers by Certain Establishments) Act, 1988
Ganga Press, a newspaper establishment, is a small establishment. Its HR manager keeps the Form II and Form III registers on a computer and furnishes Form I by email. During an inspection, the Inspector asks for the registers. Which view is correct under the Act?
Electronic maintenance is valid, and a printout must be made available to the Inspector on demand. The Act permits returns and registers in physical or electronic form on that condition, and allows Form I to be emailed if the authority can receive electronic mail.
- AElectronic maintenance is invalid; only physical registers are permitted
- BElectronic maintenance is valid, and a printout must be made available to the Inspector on demandCorrect
- CElectronic maintenance is valid, and no printout need be given in any case
- DElectronic form is valid for registers, but Form I can never be sent electronically
Explanation
Section 4(2) permits Form I, registers and wage records in physical form or on a computer or other electronic media, provided a printout is made available to the Inspector on demand. Section 4(3) allows Form I to be furnished by electronic mail if the Inspector or authority has the facility to receive it. So the last option is wrong, and the third ignores the printout condition.
