Imported goods were assessed to duty provisionally under section 18, and the provisional duty was paid on 5 June 2024. Final assessment was completed on 20 January 2025. For the two-year period for entering the goods for export under section 74, from which date is the period reckoned?

The two-year period runs from 5 June 2024. Under section 74(4)(b), for goods provisionally assessed under section 18, the date of payment of the provisional duty is deemed to be the date of payment of duty, so final assessment does not restart the period.

  1. A5 June 2024, the date of payment of provisional dutyCorrect
  2. B20 January 2025, the date of final assessment
  3. CThe date of the bill of entry for home consumption, irrespective of payment
  4. DThe date on which the claim for drawback is filed

Explanation

Section 74(4)(b) deems the date of payment of the provisional duty to be the date of payment of duty for provisionally assessed goods. The period therefore runs from 5 June 2024, not from final assessment.
