In a dispute, Mehta Exports Ltd claims a contract e-document was signed by director Rohan Iyer with his digital signature, which he denies. Under the Bharatiya Sakshya Adhiniyam, 2023, which step may the Court direct to ascertain whether the digital signature is his?

The Court may direct any other person to apply the public key listed in the Digital Signature Certificate and verify the signature, and may also direct the person, the Controller or the Certifying Authority to produce the certificate, as provided in Section 73 of the Bharatiya Sakshya Adhiniyam, 2023.

  1. ADirect the Controller to destroy the Digital Signature Certificate
  2. BPresume the signature genuine without any verification
  3. CDirect any other person to apply the public key listed in the Digital Signature Certificate and verify the signatureCorrect
  4. DDirect only the company's auditor to certify the signature

Explanation

Section 73 allows the Court to direct that person, the Controller or the Certifying Authority to produce the Digital Signature Certificate, or any other person to apply the public key listed in the certificate and verify the signature. A blanket presumption or auditor certification is not what the section provides.
