CS Executive · Jurisprudence, Interpretation and General Laws · Sources of Law

In jurisprudence, the sources of law are commonly divided into two broad classes. Which pair correctly names this classification?

The standard classification divides sources of law into formal sources and material sources. Formal sources give law its binding authority, such as legislation, precedent and custom, while material sources supply the substance or content from which the law is drawn, such as historical and legal materials.

  1. ASubstantive sources and procedural sources
  2. BFormal sources and material sourcesCorrect
  3. CPrimary sources and tertiary sources
  4. DWritten sources and unwritten sources only

Explanation

Jurisprudence classifies sources into formal sources, from which law derives its binding force and validity (legislation, precedent, custom), and material sources, which supply the content of law (such as legal and historical sources). The other pairs are not the standard classification used in the syllabus.
