Kaveri Engineering applied for registration of its establishment under the OSH Code, but the registering officer neither registered it nor entertained the application within the prescribed period. What is the legal consequence?

The establishment is deemed registered immediately when the prescribed period expires, and the electronic registration certificate is auto generated. The responsibility for the failure rests on the registering officer, so the employer need not reapply or appeal.

  1. AThe establishment is deemed registered on expiry of the period and a certificate is auto generatedCorrect
  2. BThe employer must reapply and cannot employ anyone until the officer acts
  3. CThe application lapses and a fresh late fee is payable
  4. DThe establishment is deemed registered only after the employer appeals under section 4

Explanation

The Code's proviso says that if the registering officer fails to register or entertain the application within the prescribed period, the establishment is deemed registered immediately on expiry of that period. The electronic certificate is auto generated, and the responsibility for the failure rests on the registering officer. No appeal or fresh application is needed.
