CS Executive · Setting Up of Business, Industrial and Labour Laws · Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013

Kavita faced an incident of harassment on 10 January. She was unable to file a complaint within the normal period because of a serious illness. Under section 9 of the POSH Act, 2013, up to what latest date may the Committee allow her complaint, assuming it records reasons and is satisfied about the circumstances?

The latest date is about six months from the incident. Section 9 requires a complaint within three months, and the Committee may extend this by not more than three months, after recording reasons in writing and being satisfied that circumstances prevented the woman from filing earlier.

  1. AThree months from the incident only, with no extension
  2. BSix months from the incident, by extending the three-month period by up to three monthsCorrect
  3. CNine months from the incident
  4. DOne year from the incident

Explanation

The normal limit is three months from the incident. The proviso lets the Committee extend the time by not exceeding three months, with reasons recorded in writing, so the outer limit is six months. Nine months would wrongly add a second extension.
