Meera Publications obtained entry of its novel in the Register of Copyrights. The entry shows the author's name as 'Rajeev Menon' although the correct name is 'Rajiv Menon', a mere spelling error. Which authority may amend the entry, and under which power?

The Registrar of Copyrights can correct the author's misspelt name. Section 49 empowers the Registrar, in prescribed cases and on prescribed conditions, to amend the Register by correcting errors in any name, address or particulars, so no High Court order is needed.

  1. AThe Registrar of Copyrights, by correcting an error in a name, address or particulars under Section 49Correct
  2. BThe High Court only, since every change in the Register needs a court order
  3. CThe Registrar of Trade Marks, by treating the error as a trade mark defect
  4. DThe Central Government, by issuing a notification for each such entry

Explanation

Section 49 lets the Registrar of Copyrights, in prescribed cases and subject to prescribed conditions, correct any error in a name, address or particulars. A spelling error in the author's name falls squarely within this. The High Court route under Section 50 is for rectification, not for simple clerical corrections.
