Meridian Securities Ltd's Digital Signature Certificate was suspended by the Certifying Authority on the written request of its authorised signatory, Mr. Rao, who is duly authorised to act for the subscriber. Under the Information Technology Act, 2000, what must the Certifying Authority do on suspending the certificate?

The Certifying Authority must communicate the suspension to the subscriber. The Act allows suspension on request of the subscriber or a duly authorised person, and requires the subscriber to be informed on suspension. A hearing is needed only where suspension would exceed fifteen days.

  1. ACommunicate the suspension to the subscriberCorrect
  2. BObtain prior approval of the Controller before suspension
  3. CHold a hearing before suspending for even one day
  4. DDelete the certificate from every repository permanently

Explanation

Section 37(1)(a) allows suspension on the request of the subscriber or a person duly authorised to act for the subscriber. Section 37(3) requires the Certifying Authority to communicate the suspension to the subscriber. A hearing is needed only if suspension is to exceed fifteen days, so the hearing option is wrong.
