Orion Retail Ltd and Vasudha Mart Ltd notified a proposed merger on 1 March. The Commission has not passed any order under section 31. Under section 6(2A), the earliest the combination may come into effect, absent a section 31 order, is after how many days from the notice?

The combination cannot take effect until one hundred and fifty days have passed from the notice, unless the Commission passes an order under section 31 sooner. The earlier two hundred and ten day period was replaced by the 2023 amendment.

  3. COne hundred and fifty daysCorrect
  4. DTwo hundred and ten days

Explanation

Section 6(2A) says no combination comes into effect until 150 days have passed from the notice, or the Commission passes orders under section 31, whichever is earlier. The 210 days figure is the earlier period that was substituted by the 2023 amendment, so it is no longer correct.
