Ravi contracts to pay Sunita Rs. 50,000 when Sunita marries Anil. Anil dies without having married Sunita. What is the legal position of the contract?
The contract becomes void. Under Section 32, a contingent contract depending on an event happening becomes void if that event becomes impossible. Anil's death before marriage makes the contingent event impossible, so Ravi's promise cannot be enforced.
- AIt remains enforceable after one year
- BIt is voidable at Ravi's option
- CIt becomes voidCorrect
- DIt is enforceable for half the sum
Explanation
Section 32 says that if the event becomes impossible, such contracts become void. Anil's death makes the marriage impossible, as in the illustration of a payment on marriage to C who dies unmarried. It is void, not voidable.
