Rohan's father wants to settle a trust of Rs 8 lakh of his 15-year-old son Rohan's own money for Rohan's medical needs, acting on Rohan's behalf. Under the Indian Trusts Act, 1882, how may a trust be validly created by or for this minor?

A trust by or on behalf of a minor may be created only with the permission of a principal Civil Court of original jurisdiction. The father's consent alone does not suffice, because a minor is not competent to contract and the Act requires court permission.

  1. AWith the permission of a principal Civil Court of original jurisdictionCorrect
  2. BWith the father's consent alone, as natural guardian
  3. CBy registering it as a society under the Societies Registration Act, 1860
  4. DA minor's property cannot be settled in trust in any case

Explanation

Section 7(b) allows a trust to be created by or on behalf of a minor with the permission of a principal Civil Court of original jurisdiction. Parental consent alone is not enough. The minor is not competent to contract under 7(a), so the court route is the only one. Registration as a society is irrelevant.
