Section 16(2)(c) makes the condition that tax charged on the supply has been actually paid to the Government 'subject to the provisions of' which provision, following its amendment w.e.f. 1 October 2022?
After 1 October 2022, Section 16(2)(c) is subject to Section 41 alone. The reference to Section 43A was omitted by Act 6 of 2022, so the earlier wording citing both sections no longer applies.
- ASection 41Correct
- BSection 41 or Section 43A
- CSection 37 only
- DSection 49 only
Explanation
Section 16(2)(c) reads 'subject to the provisions of section 41'. The words 'or section 43A' were omitted by Act 6 of 2022 w.e.f. 1 October 2022. So the option citing both sections reflects the old text and is wrong.
