Sunrise Foods Ltd of Pune runs a misleading advertisement for its health drink. A consumer group wants to complain about it as prejudicial to the interests of consumers as a class, and not as an individual grievance. Under Section 17 of the Consumer Protection Act, 2019, to which authority may such a complaint be forwarded?

Such a complaint may be forwarded to any one of the District Collector, the Commissioner of regional office or the Central Authority. The Central Council is merely advisory and is not a complaint authority, so it is the wrong choice for complaints about misleading advertisements affecting consumers as a class.

  1. AThe Central Consumer Protection Council, being the apex advisory body
  2. BThe District Collector, the Commissioner of regional office or the Central AuthorityCorrect
  3. COnly the National Consumer Disputes Redressal Commission
  4. DThe Insolvency and Bankruptcy Board of India

Explanation

Section 17 allows a complaint about violation of consumer rights, unfair trade practices or false or misleading advertisements prejudicial to consumers as a class to be sent to any one of the District Collector, the Commissioner of regional office or the Central Authority. The Central Council under Section 3 is only an advisory body, so it is not a forum for such complaints.
