Sunrise Textiles Pvt Ltd in Surat has three registered trade unions among its workers. The Shramik Sangh has the support of 56% of the workers on the muster roll, verified in the prescribed manner. Under the Industrial Relations Code, 2020, what must the employer do?

The employer must recognise Shramik Sangh as the sole negotiating union. When several registered unions operate, the one backed by fifty-one per cent or more of workers on the verified muster roll gets sole recognition, and a negotiating council is needed only if none reaches that level.

  1. ARecognise Shramik Sangh as the sole negotiating union of the workersCorrect
  2. BConstitute a negotiating council with representatives of all three unions equally
  3. CRefuse recognition until all three unions agree to a single union
  4. DRecognise the union only if the appropriate Government directs it

Explanation

Where more than one registered union functions in an establishment, the union supported by 51% or more of the workers on the muster roll must be recognised by the employer as sole negotiating union. At 56% Shramik Sangh clears this threshold. A negotiating council arises only when no union reaches 51%.
