CS Executive · Setting Up of Business, Industrial and Labour Laws · The Code on Social Security, 2020

The Central Government forms the opinion that the National Social Security Board has persistently delayed discharging its functions. What must it do before notifying its supersession under Section 11?

Before superseding the National Social Security Board, the Central Government must give it an opportunity to show cause and consider its explanations and objections. The report to Parliament is laid afterwards, not later than three months from the notification of supersession.

  1. AGive the Board an opportunity to show cause and consider its explanations and objectionsCorrect
  2. BObtain prior approval of the Supreme Court
  3. CWait for a resolution of the State Legislatures
  4. DLay a report before Parliament before issuing the notification

Explanation

The proviso to Section 11(1) requires an opportunity to show cause and consideration of the explanations and objections before the notification. The report to Parliament is laid after the action, within three months of the notification under Section 11(3), so laying it beforehand is wrong.
