The Municipal Council of a city in a State was dissolved before the end of its five-year term because of mismanagement. The State government proposes to hold the election to constitute the new council only after one year, giving no reason beyond administrative convenience. Under Part IXA, what is the position?

The delay is invalid. Part IXA requires that after premature dissolution of a municipality, the election to constitute the new body be completed before six months from the date of dissolution. Administrative convenience or Governor approval does not extend this period.

  1. AValid, since the State may take up to one year to hold the election
  2. BInvalid, because the election must be completed before the expiry of six months from the date of dissolutionCorrect
  3. CInvalid, because the election must be held within thirty days of dissolution
  4. DValid, if the Governor approves the delay

Explanation

Part IXA requires that where a municipality is dissolved before its term ends, the election to constitute the new body must be completed within six months from the date of dissolution. A one-year delay for administrative convenience breaches this. Thirty days is not the stated period.
