Veda Textiles Ltd wants to route its CSR money for rural sanitation to Gramodaya Seva Samiti, a registered society that has run sanitation projects for exactly two years. The society was not established by Veda Textiles or by any of its group companies. Under the Companies (CSR Policy) Rules, 2014, can the society be used as an implementing agency?

The society cannot be used. An outside registered society, trust or Section 8 company that is not set up by the company, its group or the Government needs at least three years of track record in similar activities. Gramodaya has only two years, so it is ineligible.

  1. AYes, because any registered society can implement CSR projects
  2. BNo, because an outside registered society needs an established track record of at least three years in similar activitiesCorrect
  3. CYes, provided the society has a track record of at least one year
  4. DNo, because a society can never be an implementing agency

Explanation

A registered society, trust or Section 8 company that was not established by the company or its group, nor by the Government, must have an established track record of at least three years in similar activities. Gramodaya has only two years, so it does not qualify. The claim that any registered society qualifies ignores this track record condition.
