Which of the following is correctly classified as a persuasive source rather than an authoritative source in the Indian context?
A judgment of the English House of Lords is a persuasive source in India. Indian courts may consider its reasoning but are not bound to follow it. Supreme Court decisions, Acts of Parliament and constitutional provisions are authoritative and compulsorily binding on courts.
- AA Supreme Court judgment on a point of law
- BA Central Act passed by Parliament
- CA judgment of the English House of Lords on a similar pointCorrect
- DA provision of the Constitution of India
Explanation
Persuasive sources have no binding force and are followed only for their reasoning. A foreign judgment such as one from the House of Lords can be considered by Indian courts but need not be followed. The other three options are binding on the courts and thus authoritative.
