The Code on Wages, 2019 is a central law that extends to the whole of India. It requires employers to pay at least the notified minimum rate of wages, pay overtime at not less than twice the normal rate, and pay wages and bonus within fixed time limits. Learn the rules with their exact conditions and time periods.
What this chapter covers
The Code on Wages, 2019 is a labour law that deals with wages, bonus and related payments. It extends to the whole of India. It comes into force on dates the Central Government notifies, and different dates can be set for different provisions. So when you write about commencement, say this and do not assume one single date.
The chapter has a clear logic. First you learn the key definitions. Then you learn how minimum wages are fixed and who must pay them. Next come special cases: piece work, a part day of work, and overtime. Then you learn when and how wages and bonus must be paid. The last block covers the authorities, claims, offences and penalties that enforce all this.
In Paper 5 this chapter sits with the other business laws. It is a statute-based chapter, so the marks come from stating the rule correctly, with its conditions and numbers. It is also a good place for short case-based questions, where you apply a rule to a given situation. Ethics-style thinking helps too: fair pay and timely payment are the point of the law.
This chapter is short in concept but rich in exact details: time limits, the overtime rate, and who may be denied wages. These are easy to turn into MCQs, and they are equally easy to apply in a written case. If you learn the rules with their conditions, you can score well in both Section A and the descriptive questions. Because the numbers are fixed, careful revision gives you marks with little risk.
The Code on Wages, 2019: topics in the order to study them
- 1Code on Wages 2019: Short Title, Extent and CommencementIt is short and sets the frame: the name of the Code, that it extends to the whole of India, and that it starts on notified dates.
- 2Definitions under the Code on Wages, 2019Every later rule uses terms such as wages, employee and employer, so you need these first.
- 3Minimum Wages and Fixation of Minimum Rate of WagesThis is the core of the Code: no employer may pay below the notified minimum rate, and the Government fixes rates for time work or piece work by hour, day or month.
- 4Minimum Time Rate Wages for Piece WorkIt builds on fixation of rates: where only a minimum time rate is fixed for piece work, the employer must pay at not less than that rate.
- 5Wages for Less Than Normal Working Day and Overtime WorkThese are special cases of paying the minimum rate, covering a part day of work and work beyond the normal working day.
- 6Payment of Wages, Deductions and BonusOnce you know what is payable, you learn when and how it must be paid, including the time limits for wages and bonus.
- 7Authorities, Claims, Offences and PenaltiesStudy it last, because it covers the enforcement of every rule you have already learned.
How to prepare The Code on Wages, 2019
Treat this as a rules chapter. Your aim is to state each rule in plain words, with its condition and number, and then apply it to a short fact situation.
- Read the chapter once for the flow: definitions, minimum wages, special cases, payment, enforcement. Do not memorise on the first read.
- Make a one-page table of every time limit and number: daily wages at the end of the shift, weekly on the last working day before the weekly holiday, fortnightly before the end of the second day after the fortnight, monthly before the expiry of the seventh day of the next month, two working days on removal, dismissal, retrenchment or resignation, and bonus within eight months of the close of the accounting year.
- For each rule, write the condition next to it. For example, the overtime rate applies when an employee whose minimum rate is fixed by the hour, day or longer period works beyond a normal working day. The rate must be not less than twice the normal rate of wages, for every hour or part of an hour.
- Practise applying rules to cases. Name the rule, state it, apply it to the facts, then give the conclusion. This format earns step marks in descriptive answers.
- Solve MCQs by hunting for the exact word. Options often change one detail, such as seven days to ten days or twice to one and a half times. Check against your table.
- Revise enforcement last, and in the final week redo your table and ten short cases from memory.
Common mistakes in The Code on Wages, 2019
Writing that the Code came into force on one single date for all provisions.
Fix: Write that it comes into force on dates the Central Government notifies, and that different dates may be set for different provisions.
Mixing up the payment time limits for daily, weekly, fortnightly and monthly wages.
Fix: Learn them in order: end of shift, last working day before the weekly holiday, before the end of the second day after the fortnight, before the expiry of the seventh day of the next month.
Saying overtime is paid at double the rate, without the words 'not less than'.
Fix: State it as an overtime rate not less than twice the normal rate of wages, for every hour or part of an hour worked in excess of a normal working day.
Saying a daily-rated worker is always paid for a full day if he works part of it.
Fix: Add the proviso: no full-day wages if the failure to work is caused by his own unwillingness and not by the employer's omission to provide work, or in other prescribed cases.
Confusing the bonus time limit with the wage time limits.
Fix: Keep bonus separate: eight months from the close of the accounting year, with an extension capped at two years in total.
Giving a conclusion in a case question without naming the rule.
Fix: Use four steps: the rule, its condition, the facts, the conclusion. Each step carries marks.
