CS Executive · Setting Up of Business, Industrial and Labour Laws
The Code on Wages, 2019 for CS Executive
The Code on Wages, 2019 is the labour law that governs minimum wages, floor wage, overtime, time of payment, deductions and bonus. For CS Executive, learn the sections in order, remember the exact conditions and time limits, then write answers as provision, facts, conclusion, citing the section.
What this chapter covers
This chapter sits in Paper 3, Part II (Industrial and Labour Laws). The Code on Wages, 2019 is one of the four Labour Codes taught in this part. It replaced older wage laws and brings minimum wages, payment of wages, bonus and equal remuneration under one Code.
The chapter has a clear logic. First you learn who and what the Code covers and its definitions. Then you learn how minimum wages are fixed: the Central Government fixes a floor wage, and the appropriate Government fixes minimum rates that cannot be below it. After that come the working rules: piece work, normal working day, overtime, and payment of wages with deductions and bonus. The chapter ends with enforcement: authorities, inspections, offences and penalties.
It connects to the other Labour Codes in the same part. Definitions such as wages, employee and employer come up again when you study social security and industrial relations. Practical questions often need you to apply a section to a short fact pattern, so keep the sections and their numbers handy.
Paper 3 Part II carries 40 marks and the Code on Wages is a core, self-contained chapter within it. Its rules are specific: time limits, rates, conditions and duties of the employer. That makes it ideal for short-answer and problem-style questions where you state the section, apply it and conclude. Since it is a descriptive paper, precise language and correct section numbers earn marks that general knowledge cannot. Students who learn this chapter well can score reliably, because the provisions are short and logical.
The Code on Wages, 2019: topics in the order to study them
- 1Code on Wages 2019: Introduction and ApplicabilityStart with the purpose and scope of the Code so every later rule has context.
- 2Key Definitions under the Code on WagesTerms like wages, employee, employer and appropriate Government are used in every section that follows.
- 3Minimum Wages and Floor WageThis is the heart of the Code: sections 5, 6 and 9 on payment, fixation of minimum rates and the floor wage.
- 4Minimum Time Rate Wages for Piece WorkBuilds on minimum wage fixation and covers section 12 and the piece rate versus time rate idea.
- 5Wages for Overtime and Less Than Normal Working DayNeeds minimum wage concepts first; covers sections 10, 11, 13 and 14 on hours, day of rest and overtime at not less than twice the normal rate.
- 6Payment of Wages, Deductions and BonusCovers time limits under section 17, then deductions and bonus; study after you know what wages are and how they are fixed.
- 7Authorities, Inspections, Offences and PenaltiesEnforcement makes sense only after you know the duties being enforced, so study it last.
How to prepare The Code on Wages, 2019
This chapter rewards accuracy over volume. Aim to know each rule with its condition, then practise applying it.
- Read the introduction and definitions first and write a one-line meaning for each key term in your own words.
- Make a one-page chart of sections 5, 6 and 9: who fixes what, and the rule that minimum rates cannot be below the floor wage and cannot be reduced if already higher.
- Build a table of time limits under section 17: daily at the end of the shift, weekly before the weekly holiday, fortnightly before the end of the second day after the fortnight, monthly before the expiry of the seventh day of the next month, and two working days on removal, dismissal, retrenchment or resignation.
- Learn sections 10 to 14 as a group: less than a normal day, two classes of work, piece work, hours and day of rest, and overtime. Practise small numerical examples, such as overtime at twice the normal rate.
- Write two or three answers in ICSI style: state the provision, apply it to the facts, then give a clear conclusion citing the section.
- Revisit the enforcement topic last and note what is left to rules made by the appropriate Government under section 67, since the Code often says 'as may be prescribed'.
- Revise from your own charts a few days before the exam and re-check any section number you are unsure of.
Common mistakes in The Code on Wages, 2019
Writing that overtime is paid at 'double' without the condition, or giving a lower rate.
Fix: Write that the overtime rate shall not be less than twice the normal rate of wages, for every hour or part of an hour worked in excess, as per section 14.
Mixing up the time limits for payment of wages.
Fix: Make a small table of the daily, weekly, fortnightly, monthly and on-exit limits under section 17 and revise it often.
Saying the State Government fixes the floor wage.
Fix: Remember that the Central Government fixes the floor wage under section 9, and the appropriate Government's minimum rates must not be below it.
Forgetting that an employee gets a full day's wages when work is short because the employer gave no work.
Fix: State the rule and both exceptions: the employee's unwillingness to work, and other prescribed cases.
Answering problem questions without citing the section or giving a conclusion.
Fix: Follow the ICSI pattern: provision with section, application to the facts, then a clear conclusion.
Treating the old wage laws as the current law.
Fix: Answer on the basis of the Code on Wages, 2019 and its sections, and mention earlier laws only when contrasting.
