Deemed Profits, Speculation and Business Losses: Set Off and Carry Forward

Updated 10 October 2026 · Fact-checked

Speculation business loss under the Income-tax Act, 2025 can be set off only against profits of another speculation business. Unabsorbed loss is carried forward and set off only against speculation profits, for up to four tax years after the loss year. Ordinary business loss follows section 112 with an eight-year limit.

Understand Deemed Profits, Speculation and Business Losses

A business loss is not always treated the same way. The Act sorts business losses into three baskets: ordinary business loss, speculation business loss and specified business loss. Each basket has its own set-off and carry forward rules. Your job in the exam is to put each loss in the right basket first.

An ordinary business loss is any loss under the head Profits and gains of business or profession that is not from speculation (and not from a specified business). If it cannot be set off against income of other heads under section 109, section 112 carries it forward. It can be set off only against business or profession profits of later years. The limit is eight tax years immediately after the loss year.

A speculation business loss is dealt with by section 113. It can be set off only against profit of another speculation business. If it cannot be fully set off in the same year, the balance is carried forward and set off only against speculation business profits of later years. No loss is carried forward for more than four tax years immediately after the year in which it was first computed.

Section 113(5) adds a deeming rule for companies. If part of a company's business is purchase and sale of shares of other companies, it is deemed to carry on speculation business to that extent. Section 113(6) switches this off if the company's gross total income consists mainly of income from house property, capital gains or other sources, or if its principal business is trading in shares, banking or granting loans and advances.

A specified business loss falls under section 114. It can be set off only against profits of another specified business. Section 114 as supplied states set-off and carry forward, but it gives no time limit. Do not add a number of years that the text does not state.

The rule exists to ring-fence risky or specially treated activities. Speculation losses cannot reduce your salary, rent or ordinary business profits. But a speculation profit can be absorbed by an ordinary business loss in the same year, because the restriction only works one way: it limits where speculation losses go, not what can be set against speculation profits.

Key rules to remember

Current-year set off of speculation loss (section 113(1))
Speculation loss ≤ set off only against profits of another speculation business
It cannot be set off against any other business income or any other head.
Carry forward of speculation loss (section 113(2))
Unabsorbed speculation loss → next tax year → set off against speculation profits only → repeat
Carry forward is of the loss not set off, in the following tax years.
Time limit for speculation loss (section 113(3))
Maximum 4 tax years immediately succeeding the loss year
Count from the year after the loss was first computed.
Ordinary business loss carry forward (section 112)
Loss not set off under section 109 → carried forward → set off against business or profession profits of later years, up to 8 tax years
The loss must not be a speculation loss. It can be set off against any business profit, including speculation profit.
Specified business loss (section 114)
Set off only against profits of another specified business; unabsorbed balance carried forward against specified business profits
The supplied text of section 114 states no number of years.
Company share dealing (section 113(5) and (6))
Company deemed in speculation business to the extent of purchase and sale of shares of other companies, unless an exception applies
Exceptions: gross total income mainly from house property, capital gains or other sources; or principal business is share trading, banking or granting loans and advances.

How to solve Deemed Profits, Speculation and Business Losses questions

Use this method for any question on business loss set off and carry forward.

  1. 1List each business activity and compute its profit or loss separately. Mark each as ordinary, speculation or specified.
  2. 2For a company, check section 113(5): is any share purchase and sale deemed speculation? Then check the section 113(6) exceptions.
  3. 3Set off current-year losses. Ordinary business loss goes against other business income and other heads as section 109 allows. Speculation loss goes only against speculation profit.
  4. 4Compute the unabsorbed amount of each basket and carry it forward under its own section (112, 113 or 114).
  5. 5For brought forward losses, set off against the correct type of profit only. Brought forward speculation loss is set off against speculation profit only.
  6. 6Check the time limit: four tax years for speculation loss, eight for ordinary business loss, counted from the year after the loss year.
  7. 7Show a clear working: current-year result, set-off, balance carried forward, and the year in which each balance lapses.

Quickest way: Three-basket tick check

When to use it: Use when a question gives several businesses and old losses and asks for income or loss to carry forward.

  1. Draw three columns: ordinary, speculation, specified.
  2. Put each profit or loss in its column. Brought forward losses go in the same column.
  3. Net each column. A speculation loss never moves out of its column.
  4. Ordinary loss can absorb other income, including speculation profit. Speculation loss cannot absorb anything outside its column.
  5. Write the carry forward balance and the last year of use: 4 years for speculation, 8 for ordinary.

Common mistakes in Deemed Profits, Speculation and Business Losses

  • Setting off a speculation loss against ordinary business profit or salary.

Students treat all business losses alike.

Fix: Remember section 113(1): speculation loss goes only against profit of another speculation business.

  • Using eight years for speculation loss.

Mixing up section 112 and section 113.

Fix: Speculation loss: four tax years. Ordinary business loss: eight tax years.

  • Setting off a brought forward ordinary business loss against a different head such as house property income.

Confusing current-year set off with carry forward.

Fix: Under section 112, carried forward business loss is set off only against profits and gains of business or profession of later years.

  • Treating a company's share trading as speculation in every case.

Forgetting the exceptions in section 113(6).

Fix: Check whether the company's gross total income is mainly from house property, capital gains or other sources, or its principal business is share trading, banking or lending.

  • Carrying forward speculation loss to a year after the four-year limit.

Counting years from the wrong starting point.

Fix: Count four tax years that immediately follow the loss year. Write the last usable year in your answer.

Worked examples

Example 1

Mr. Rohan Mehta has the following results for the tax year 2026-27: ordinary business profit ₹6,00,000; speculation business loss ₹2,50,000. Brought forward from earlier years: nil. Compute the business income and the loss carried forward.

Show the solution
  1. Speculation loss of ₹2,50,000 can be set off only against another speculation business profit.
  2. He has no other speculation business, so no set off is allowed in 2026-27.
  3. Ordinary business profit stays at ₹6,00,000.
  4. The unabsorbed speculation loss of ₹2,50,000 is carried forward under section 113(2).
  5. It can be set off only against speculation profits for the four tax years immediately succeeding 2026-27, that is up to 2030-31.

Answer: Business income for 2026-27 is ₹6,00,000. Speculation loss of ₹2,50,000 is carried forward, usable against speculation profits up to tax year 2030-31.

Example 2

Ms. Kavita Rao has the following for the tax year 2026-27: profit from speculation business A ₹1,80,000; loss from speculation business B ₹70,000; loss from ordinary business ₹90,000; income from house property ₹2,00,000. Brought forward speculation loss: ₹60,000. Compute the net result and loss carried forward.

Show the solution
  1. Set off current-year speculation loss against speculation profit: ₹1,80,000 − ₹70,000 = ₹1,10,000.
  2. Set off brought forward speculation loss against speculation profit: ₹1,10,000 − ₹60,000 = ₹50,000 net speculation profit.
  3. Ordinary business loss of ₹90,000 can be set off against other heads under section 109. Assume it is set off against house property income: ₹2,00,000 − ₹90,000 = ₹1,10,000. It could equally be set off against the speculation profit, as the restriction applies only to speculation losses.
  4. Taking the house property route, gross total income is ₹50,000 + ₹1,10,000 = ₹1,60,000.
  5. No loss is left to carry forward.

Answer: Net speculation profit is ₹50,000, house property income after set off is ₹1,10,000, gross total income is ₹1,60,000 and no loss is carried forward. Brought forward speculation loss is fully used.

Exam tips

  • Start every answer by naming the type of loss and the section. Step marks follow the classification.
  • In MCQs, watch the words 'only against'. The correct option usually reflects that speculation loss is ring-fenced.
  • Write the last year of carry forward. Examiners often test the four-year versus eight-year difference.
  • For company questions, test section 113(5) and the section 113(6) exceptions before computing.
  • Show each column of your working separately so partial credit is easy to award.
