International and Emerging Aspects under Mediation Law

This chapter covers the Mediation Act, 2023 beyond the basic process: when a mediation is international, how a mediated settlement agreement is enforced, the 120-day time limit, the Mediation Council of India, the Act's overriding effect, and online and community mediation. In the exam, state the section, apply it to the facts, and conclude.

What this chapter covers

This chapter takes the Mediation Act, 2023 beyond the basic process. You study when a mediation counts as international mediation, how a settlement is enforced, how long a mediation can run, who regulates the field, and how the Act sits with other laws. It ends with two newer forms: online mediation and community mediation.

The chapter connects to the Mediation part of Paper 7.1, which carries 30 marks, and it links to the arbitration and conciliation parts. Section 3(h) defines mediation to include conciliation, so the Act reaches into ground you also study under the Arbitration and Conciliation Act. Section 55 explains how the two sets of rules fit together.

The paper is written and case-based. Expect a short fact pattern with a question such as whether a dispute is international, whether a mediation has ended, or whether a settlement can be enforced. Your answer needs the provision, an application to the facts, and a clear conclusion.

The chapter is rich in precise, rule-based points that suit case-based questions. Definitions, time limits, termination grounds and Council functions are exact and can be learned with accuracy. A student who knows the exact conditions in Sections 3(g), 18, 24, 27 and 55 can write short, complete answers quickly. This also helps in practical drafting and advisory questions, where you must tell a client whether a process is valid, still running or enforceable.

International and Emerging Aspects under Mediation Law: topics in the order to study them

  1. 1International Mediation under the Mediation Act, 2023Start with the definition in Section 3(g), because it sets the scope for everything else in the chapter.
  2. 2Time-limit for Completion of Mediation (Section 18)It is a short, numerical rule, and it links directly to termination under Section 24.
  3. 3Enforcement of Mediated Settlement AgreementsOnce you know when mediation ends, you can study how a settlement agreement becomes binding and enforceable under Section 27.
  4. 4Mediation Council of India: Duties and Functions (Section 38)It is a list-based topic, so learn it after the process rules and compare it with the functions of service providers in Section 41.
  5. 5Overriding Effect of the Mediation Act (Section 55)You need the earlier topics to see how the Act interacts with other laws and the Second Schedule.
  6. 6Emerging Trends: Online Mediation and Community MediationStudy it last because it builds on the general rules and adds special features, especially the non-enforceable community settlement.

How to prepare International and Emerging Aspects under Mediation Law

Treat this chapter as a set of exact provisions plus application. Read the section text, then practise short fact-based answers.

  1. Read Sections 3, 18, 24, 27, 38, 41 and 55 from the Act and mark the exact conditions in each.
  2. Make a one-page table-style note in your own words for the Section 3(g) test: commercial dispute, and at least one party foreign by individual, body corporate, association or foreign Government.
  3. Learn the timeline: 120 days from the date fixed for first appearance, extendable by agreement of the parties for up to 60 days more, and link it to termination under Section 24.
  4. Group the Council's duties under Section 38 into themes such as promotion, mediator regulation, institution recognition and records, and contrast them with the functions of service providers in Section 41.
  5. Compare enforcement of a mediated settlement agreement under Section 27 with the community mediation settlement, which Section 44(4) says is not enforceable as a civil court judgment or decree.
  6. Practise three or four case-style questions in the format of provision, application and conclusion, and keep each answer within the time you would have in the exam.
  7. Revise by closing the book and writing each rule from memory, then checking the exact words.

Common mistakes in International and Emerging Aspects under Mediation Law

  • Treating any cross-border dispute as international mediation.

Fix: Check both limbs of Section 3(g): the dispute must be commercial under the Commercial Courts Act, 2015, and at least one party must fall in the listed foreign categories.

  • Counting the 120 days from the date of the agreement or the application.

Fix: Count from the date fixed for the first appearance before the mediator, and remember the extension needs the parties' agreement and is capped at 60 days.

  • Saying the extension under Section 18(2) can be given by the mediator on his own.

Fix: State that the extension is as agreed by the parties and cannot exceed 60 days.

  • Listing only some grounds of termination, or missing that expiry of time also ends mediation.

Fix: Learn all four grounds in Section 24 and tie ground (d) to Section 18.

  • Applying the enforcement rule of Section 27 to community mediation settlements.

Fix: Remember that Section 44(4) says a community settlement serves peace and harmony and is not enforceable as a judgment or decree of a civil court.

  • Mixing up the functions of the Council with those of mediation service providers.

Fix: Link Section 38 to regulation, recognition and guidelines, and Section 41 to panels, facilities and facilitating registration of settlements.

International and Emerging Aspects under Mediation Law: frequently asked questions

When is a mediation international under the Mediation Act, 2023?

It must relate to a commercial dispute arising out of a legal relationship under any law in force in India, and at least one party must be foreign. That can be a foreign national or resident, a body corporate or LLP with its place of business abroad, a foreign association, or a foreign Government. Check both conditions in Section 3(g).

How long can a mediation last under the Act?

It must be completed within 120 days from the date fixed for the first appearance before the mediator. The parties can agree to extend it for a further period not exceeding 60 days. If the time limit expires, the mediation is deemed to terminate under Section 24.

How is a mediated settlement agreement enforced?

If it is signed by the parties and authenticated by the mediator, it is final and binding. Subject to Section 28, it is enforced under the Code of Civil Procedure, 1908 as if it were a judgment or decree of a court.

What does Section 55 of the Mediation Act do?

It gives the Act overriding effect for the conduct of mediation or conciliation despite inconsistent provisions in other laws. This is subject to the enactments listed in the Second Schedule, which the Central Government can amend by notification.

Is a community mediation settlement enforceable like a court decree?

No. Under Section 44(4), a settlement under community mediation is meant to maintain peace, harmony and tranquillity among residents or families of an area. It is not enforceable as a judgment or decree of a civil court.
