A Central Act passed by Parliament states no date for its commencement. Under the General Clauses Act, 1897, when does it come into operation?
An Act of Parliament with no stated commencement date comes into operation on the day it receives the President's assent, as provided in section 5(1) of the General Clauses Act, 1897. Introduction in a House or publication does not determine commencement.
- AOn the day it receives the assent of the PresidentCorrect
- BOn the day it is introduced in the Lok Sabha
- COn the day it is published in newspapers
- DOn the first day of the next financial year
Explanation
Section 5(1) says that where a Central Act does not express a commencement day, it comes into operation on the day it receives assent; for an Act of Parliament this is the President's assent. Introduction in the House or publication elsewhere does not fix the date. The financial-year option has no basis in the section.
