A Central Act provides that a licence shall remain valid "from 1 April to 30 April". Applying Section 9 of the General Clauses Act, 1897 on excluding and including days, which days are covered?
The first day, 1 April, is excluded and the last day, 30 April, is included. Section 9 of the General Clauses Act says the word "from" excludes the first day in a period and the word "to" includes the last day.
- A1 April is excluded and 30 April is excluded
- B1 April is included and 30 April is excluded
- C1 April is excluded and 30 April is includedCorrect
- D1 April is included and 30 April is included
Explanation
Section 9(1) says that the word "from" is sufficient to exclude the first day in a series of days, and the word "to" is sufficient to include the last day. So 1 April is excluded and 30 April is included. Counting both ends would ignore this rule.
