A Certifying Authority suspends Ananya's Digital Signature Certificate at her request. Under the Information Technology Act, 2000, what is the position if the suspension is to continue beyond fifteen days?
A Digital Signature Certificate cannot be suspended for more than fifteen days unless the subscriber has been given an opportunity of being heard. So a longer suspension is possible only after such a hearing, not automatically.
- AIt cannot exceed fifteen days under any circumstance
- BIt may continue beyond fifteen days only if the subscriber has been given an opportunity of being heardCorrect
- CIt may continue automatically for any period without notice
- DIt may continue only if the Controller issues a fresh licence
Explanation
Section 37(2) provides that a certificate shall not be suspended for a period exceeding fifteen days unless the subscriber has been given an opportunity of being heard. So a longer suspension is not impossible, but needs the hearing. Saying it can never exceed fifteen days is therefore wrong.
