An electronic signature is deemed to be a secure electronic signature if, at the time of affixing, the signature creation data was under which of the following conditions?

The signature creation data must have been under the exclusive control of the signatory and no other person when the signature was affixed. It must also have been stored and affixed in the prescribed exclusive manner. This is the test for a secure electronic signature under Section 15.

  1. AHeld jointly by the signatory and the Certifying Authority
  2. BUnder the exclusive control of the signatory and no other personCorrect
  3. CStored with the Controller of Certifying Authorities
  4. DAvailable to the relying party for verification

Explanation

Section 15 requires that the signature creation data, when the signature is affixed, was under the exclusive control of the signatory and no other person, and was stored and affixed in the prescribed exclusive manner. Joint holding with the Certifying Authority would defeat exclusivity.
