A Grievance Redressal Committee of Meera Pharma Ltd has 6 members: 3 from the employer and 3 from workers. On a worker's application, 4 members vote to reject it, including all 3 employer representatives and 1 worker representative. What is the legal consequence under the Industrial Relations Code, 2020?

It is deemed that no decision could be arrived at. A committee decision needs a majority view and also agreement by more than half of the worker representatives. Only one of three worker members agreed, so the 4-2 majority is legally insufficient.

  1. AThe rejection stands as a valid majority decision
  2. BThe decision is valid because the chairperson has a casting vote
  3. CThe committee must be reconstituted before any decision
  4. DIt is deemed that no decision could be arrived at, since more than half of the worker representatives did not agreeCorrect

Explanation

Under section 4(7) a decision is by majority view, but only if more than half of the worker-representative members agree. Here only 1 of 3 worker members agreed, which is not more than half. So no decision is deemed reached, and the worker may move on to conciliation after the time limit.
