A Gujarat trader holds a licence issued under the Standards of Weights and Measures (Enforcement) Act, 1985 that was in force when the Legal Metrology Act, 2009 commenced. The trader asks about its status. What is the position under the Act?

The licence continues in force as if it had been issued under the corresponding provisions of the Legal Metrology Act, 2009. Although the 1985 Act is repealed, section 57(3) saves licences and registrations in force at commencement, with no renewal or weights-only condition.

  1. AIt lapses immediately because that Act is repealed
  2. BIt continues in force as if issued under the corresponding provisions of the 2009 ActCorrect
  3. CIt continues only if renewed by the Central Government within one year
  4. DIt continues only for weights, not for measures

Explanation

Section 57(1) repeals the 1976 and 1985 Acts, but section 57(3) says any licence or registration issued under them, if in force at commencement, continues as if issued under the corresponding provisions of the 2009 Act. No renewal condition or weights-only limit appears in that text.
