Mehta Traders in Surat deals in goods within Gujarat only. A dispute arises over which officer appoints and supervises the legal metrology officers who handle intra-State trade. Under the Act, who appoints the Controller and Inspectors for that purpose?

The State Government appoints the Controller, Inspectors and other employees by notification for intra-State trade and commerce, under Section 14(1). The Central Government appoints officers only for inter-State trade, so for Mehta Traders in Gujarat the State appointments apply.

  1. AThe State Government, by notificationCorrect
  2. BThe Central Government, by notification
  3. CThe Director of legal metrology
  4. DThe Indian Institute of Legal Metrology

Explanation

Section 14(1) empowers the State Government to appoint the Controller, Additional, Joint, Deputy and Assistant Controllers, Inspectors and other employees for intra-State trade and commerce. The Central Government under Section 13 appoints the Director and officers for inter-State trade, so that option is wrong for this intra-State case.
