CMA Intermediate · Business Laws and Ethics · The Code on Wages, 2019

A provision of the Code on Wages, 2019 states that something must be done 'within 30 days of the commencement of this Code'. The Central Government has brought that provision into force on a date earlier than other provisions. How is the reference to commencement to be read?

Where different provisions commence on different dates, a reference in a provision to commencement of the Code is read as the coming into force of that provision itself. The period therefore runs from that provision's own commencement date, not from the first or last provision.

  1. AAs the date on which the last provision of the Code comes into force
  2. BAs the date on which that particular provision comes into forceCorrect
  3. CAs the date of Presidential assent to the Code
  4. DAs the date on which the first provision of the Code came into force

Explanation

Section 1(3) provides that a reference in any provision to commencement of the Code is construed as a reference to the coming into force of that provision. So the 30 days run from that provision's own date, not the first, last, or assent date.
