A State Government proposes to constitute its State Consumer Disputes Redressal Commission with a President and only three members. Under the Consumer Protection Act, 2019, is this composition valid?

The composition is not valid. A State Commission must consist of a President and not less than four members, up to a prescribed maximum. Three members fall short. The minimum of two members applies to District Commissions, not State Commissions.

  1. AValid, since the minimum is two members
  2. BValid, since a President and one member suffice
  3. CNot valid, since the State Commission must have a President and not less than four membersCorrect
  4. DNot valid, since it must have at least ten members

Explanation

Section 42(3) says each State Commission consists of a President and not less than four members, up to the prescribed maximum. Three members fall below this minimum. The figure of two is the minimum for a District Commission, which is why the first option is a trap.
