A State Government notifies a District Consumer Disputes Redressal Commission for Nashik district. Later, because of heavy case load, it proposes to set up a second District Commission in the same district. Under the Consumer Protection Act, 2019, what is the legal position?

The State Government may establish more than one District Commission in a district if it deems fit. The Act places this power with the State Government by notification, without needing approval from the National Commission or the Central Government.

  1. ANot permitted; only one District Commission can exist in a district
  2. BPermitted, as the State Government may establish more than one District Commission in a district if it deems fitCorrect
  3. CPermitted only with prior approval of the National Commission
  4. DPermitted only if the Central Government notifies the second Commission

Explanation

Section 28(1) requires the State Government to establish a District Commission in each district, and its proviso lets the State Government establish more than one in a district if it deems fit. No approval from the National Commission or the Central Government is required. So the first option is wrong, since the proviso expressly allows more than one.
